ORDINANCE NO. 100261

 

Approving a preliminary community unit project plan on an area of about 7.54 acres in District R-1a (One Family Dwelling - Medium Density), to allow for 11 single family residential lots and 1 open space tract, generally located on the west side of Missouri Route 1 (N. Indiana Avenue) and the east side of N. Agnes Avenue, extending approximately 840 feet south of the City of Kansas City limits on N. Walrond Avenue. (12372-CUP-5).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on approximately 7.54 acres in District R-1a (One Family Dwelling - Medium Density), to allow for 11 single family residential lots and 1 open space tract, generally located on the west side of Missouri Route 1 (N. Indiana Avenue) and the east side of N. Agnes Avenue, extending approximately 840 feet south of the City of Kansas City limits on N. Walrond Avenue, and more specifically described as follows:

 

A tract of land in the Northwest Quarter of Section 18, Township 51 North, Range 32 West of the 5th Principal Meridian in Gladstone, Clay County, Missouri, being bounded and described as follows: Commencing at the Northeast corner of the Northwest Quarter of said Section 18; thence South 00 degrees 21 minutes 49 seconds West, along the East line of said Northwest Quarter 1,801.20 feet to a point on the North line of the Gladstone City Limits; thence North 89 degrees 19 minutes 31 seconds West, along said North line, 268.44 feet to a point on the Westerly right-of-way line of Missouri State Route M-1, as now established, said point being the Point of Beginning of the tract of land to be herein described; thence South 14 degrees 12 minutes 41 seconds West, along said right-of-way line, 206.78 feet; thence South 22 degrees 33 minutes 49 seconds West, continuing along said right-of-way line, 195.71 feet; thence South 25 degrees 53 minutes 28 seconds West, continuing along said right-of-way line, 340.30 feet; thence South 34 degrees 20 minutes 39 seconds West, continuing along said right-of-way line, 146.18 feet; thence South 32 degrees 01 minutes 47 seconds West, continuing along said right-of-way line, 26.32 feet to a point on the West line of the Southeast Quarter of the Southeast Quarter of said Northwest Quarter; thence North 00 degrees 20 minutes 24 seconds East, along said West line, 113.86 feet; thence North 53 degrees 18 minutes 05 seconds West, 57.34 feet; thence North 37 degrees 56 minutes 34 seconds West, 100.50 feet; thence North 41 degrees 17 minutes 38 seconds West, 74.98 feet; thence North 23 degrees 47 minutes 17 seconds West, 100.40 feet; thence North 16 degrees 21 minutes 17 seconds West, 100.08 feet; thence North 01 degrees 56 minutes 46 seconds West, 104.40 feet; thence North 12 degrees 56 minutes 05 seconds West, 100.50 feet; thence North 27 degrees 54 minutes 40 seconds West, 110.45 feet; thence North 89 degrees 59 minutes 24 seconds West, 51.41 feet; thence North 23 degrees 18 minutes 59 seconds East, 8.45 feet; thence North 09 degrees 59 minutes 01 seconds West, 60.59 feet to a point on the North line of said Gladstone City Limits; thence South 89 degrees 19 minutes 31 seconds East, along said North line, 732.50 feet to the Point of Beginning. Containing 328,401 square feet or 7.54 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer submit an updated landscaping plan that shows existing and proposed planting within the 30 foot landscape buffer prior to ordinance request. The trees and plants to be replaced shall be installed prior to final plan approval.

 

2.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

3.                  That the developer submit new or update the previously accepted macro storm drainage study for the overall development to address the development amendments along with a detailed micro study in general compliance with adopted standards, including a BMP level of service analysis, prior to clearance of the final plat and that the developer secure permits to construct any improvements as required by Development Services prior to recording the plat.

 

4.                  That the developer dedicate additional right of way for a local street as required by Development Services so as to provide a minimum width of 50 feet of right of way for N. Waldron Avenue.

 

5.                  That the developer improve N. Waldron Avenue to local street standards as required by Development Services, including curbs, gutters, storm sewers, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

6.                  That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

7.                  That the developer subordinate to the City all private interest in the area of any right-of-way dedication, as required by Development Services, and that the developer be responsible for all costs associated with subordination activities now and in the future.

 

8.                  That after the City Plan Commission enters its disposition for the development plan, the developer shall not enter into any agreement that would encumber or otherwise have any impact on the proposed right-of-way dedications within the plan boundary without the prior written consent of Development Services.

 

9.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for review, acceptance, and permitting prior to beginning any construction activities, prior to recording the plat.

 

10.              That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more, prior to recording the plat.

 

11.              That the developer secure permits to extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services, prior to recording the plat.

 

12.              That the developer secure permits to provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services, prior to recording the plat.

 

13.              That the developer provide access restrictions to prohibit direct vehicular access to Missouri State Route M-1 from all lots or units and that the restriction be placed on the final plat.

 

14.              That the developer obtain a floodplain certificate from Development Services prior to beginning any construction activities within the floodplain.

 

15.              That the developer show the limits of the 100-year floodplain on the final plat.

 

16.              That the developer show the lowest opening or elevation or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100-year floodplain area on the final plat.

 

17.              That the developer grant a Surface Drainage Easement to the City as required by Development Services, on the final plat.

 

18.              That the developer grant a BMP Easement to the City, as required by Development Services, on the final plat.

 

19.              That the developer submit covenants, conditions and restrictions to Development Services for approval by the Law Department for the maintenance of private open space and enter into a covenant agreement for the maintenance of any private open space tracts with BMPs, prior to recording the plat.

 

20.              That the developer submit a street tree planting plan prior to or concurrent with the submittal of the final plat and secure the approval of the City Forester for street trees planted on right of way in front of residential lots, with a copy to be submitted to the Department of City Development. The plan shall include size, type, species and placement of trees. The developer shall agree to plant in accordance with the plan approved by the City Forester.

 

21.              That the developer submit a final plan to the City Plan Commission for approval including landscaping and screening within the private open space.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
