ORDINANCE NO. 970452

 

Approving an amendment to a previously approved development plan in District GP-3 (Regional Business) on approximately a 53 acre tract of land generally located on the east side of N. Congress Avenue, approximately 400 feet north of N.W. 101st Terrace. (9874-GP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-3 (Regional Business) on approximately a 53 acre tract of land generally located on the east side of N. Congress Avenue, approximately 400 feet north of N.W. 101st Terrace, and more specifically described as follows:

 

TRACT 1: A tract of land in the Northeast Quarter of Section 36, Township 52, Range 34, Kansas City, Platte County, Missouri, described as follows: Beginning at the northwest corner of said Northeast Quarter; thence South 89 53'10" East, along the north line of said Northeast Quarter, a distance of 1244.77 feet to a point on a curve; thence southeasterly, along a curve to the right, having a radius of 1300.00 feet, a central angle of 30 55'22", and whose initial tangent bearing is South 30 49'35" East, a distance of 701.62 feet; thence North 89 54'13" West, a distance of 1100.00 feet to a point on a curve; thence southwesterly, along a curve to the right, having a radius of 400.00 feet, a central angle of 55 58'51", and whose initial tangent bearing is South 0 05'47" West, a distance of 390.82 feet; thence North 89 54'13" West, a distance of 161.26 feet to a point in the west line of said Northeast Quarter; thence North 0 33'02" East, along said west line, a distance of 1000.00 feet to the point of beginning, except that part of the west now dedicated for street purposes. The above described tract contains 21.83 acres, more or less.

 

TRACT 2: A tract of land in the Northeast Quarter of Section 36, Township 52, Range 34, Kansas City, Platte County, Missouri, described as follows: Beginning at a point in the west line of said Northeast Quarter, said point being 1000.00 feet southerly from the northwest corner of said Northeast Quarter, measured along said west line having a bearing of South 0 33'02" West, thence South 89 54'13" East, a distance of 161.26 feet to a point on a curve; thence northeasterly, along a curve to the left, having a radius of 400.00 feet; a central angle of 55 58'51", and whose initial tangent bearing is North 56 04'38" East, a distance of 390.82 feet; thence South 89 54'13" East, a distance of 700.00 feet; thence South 0 05'47" West, a distance of 650.00 feet to a point in the south line of the North One-Half of said Northeast Quarter; thence North 89 54'13" West, along said south line, a distance of 1040.00 feet to the southwest corner of said North One-Half; thence North 0 33'02" East along the west line of said Northeast Quarter, a distance of 318.47 feet to the point of beginning, except that part on the west now dedicated for street purposes. The above described tract contains 12.88 acres, more or less.

 

TRACT 3: A tract of land in the Northeast Quarter of Section 36, Township 52, Range 34, Kansas City, Platte County, Missouri, described as follows: Beginning at a point in the south line of the North One-Half of said Northeast Quarter, said point being 1040.00 feet easterly from the southwest corner of said North One-Half, measured along said south line, having a bearing of South 89 54'13" East; thence North 0 05'47" East, a distance of 650.00 feet; thence South 89 54'13" East, a distance of 400.00 feet to a point on a curve; thence southwesterly, along a curve to the right, having a radius of 1300.00 feet, a central angle of 30 00'00", and whose initial tangent bearing is South 0 05'47" West, a distance of 680.68 feet to a point in said south line; thence North 89 54'13" West, along said south line, a distance of 225.83 feet to the point of beginning. The above described tract contains 5.13 acres, more or less.

 

TRACT 4: A tract of land in the Northeast Quarter of Section 36, Township 52, Range 34, Kansas City, Platte County, Missouri, described as follows: Commencing at the northwest corner of said Northeast Quarter; thence South 0 33'02" West along the west line of said Northeast Quarter, a distance of 668.45 feet; thence South 89 54'13" East, a distance of 1434.85 feet to a point on a curve; said point being the true point of beginning; thence northerly, along a curve to the left, having a radius of 1300.00 feet, a central angle of 11 26'59", and whose initial tangent bearing is North 0 05'47" East, a distance of 259.79 feet; thence North 78 38'48" East, a distance of 243.60 feet to a point on a curve; thence northeasterly, along a curve to the right, having a radius of 400.00 feet, a central angle of 260 00'00", and whose initial tangent bearing is North 50 05'47" East, a distance of 1815.14 feet; thence North 78 27'14" West, a distance of 243.60 feet to a point on a curve; thence northerly, along a curve to the left, having a radius of 1300.00 feet, a central angle of 11 26'59", and whose initial tangent bearing is North 11 32'46" East, a distance of 259.79 feet to the true point of beginning. The above described tract contains 13.03 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the development make any necessary improvements as required by

the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer dedicate additional right of way for N. Congress Avenue as required by the Department of Public Works so as to provide a total of 50 feet of

right of way as measured from the centerline of N. Congress Avenue.

 

5. That the developer improve the east half of N. Congress Avenue to primary arterial street standards as required by the Department of Public Works.

 

6. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

7. That the developer extend sanitary sewers as required by the City Engineer's Office.

 

8. That the developer secure approval of the Street Naming Committee for all street names prior to the submittal of the final plat.

 

9. That the developer grant a Noise and Aviation Easement to the City and record a fair disclosure statement.

 

10. That the developer provide for fire protection as required by the Fire Department.

 

11. That the developer contribute $69,528.78 in lieu of parkland dedication for 180 beds in satisfaction of Section 66-128 of the Subdivision Regulations.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 970452, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
