ORDINANCE NO. 951459

 

Authorizing a $100,000.00 Supplemental Agreement with Burns & McDonnell Engineering Co. for a Combined Sewer Overflow Management Plan; authorizing expenditure of $110,000.00 in funding therefor; and recognizing an emergency.

 

WHEREAS, passage of this ordinance is deemed necessary for the immediate preservation of the public health and safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to execute, on behalf of City, a $100,000.00 Supplemental Agreement with Burns & McDonnell Engineering Co. for a combined sewer overflow management plan. A copy of said agreement is on file in the office of the Director of Water Services.

 

Section 2. That the sum of $110,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Sewerage System Construction Bond Fund 815 to the following account:

 

96-815-086-7753T CSO Management Plant $110,000.00

 

Section 3. That the Director of Water Services is further authorized to expend up to the sum of $110,000.00 appropriated above to satisfy the cost of this supplemental agreement including contingencies.

 

Section 4. That upon completion of the final costs of this project, the Director of Finance is hereby directed to return the unexpended portion of this appropriation to the Unappropriated Fund Balance from which it was derived.

 

Section 5. That this ordinance is recognized to be necessary for the immediate preservation of public health and safety and therefore is an emergency measure within the provisions of Article II, Section 15 of the Charter and shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
