ORDINANCE NO. 970015
Approving the plat of Barrywoods Crossing Lot 5 Replat,
an addition in Kansas City, Platte County, Missouri; accepting and releasing
various easements.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the plat of Barrywoods Crossing Lot
5 Replat, a subdivision in Kansas City, Platte County, Missouri, a true and
correct copy of which is attached hereto and incorporated herein by reference
is hereby approved.
Section 2. That the plat granting and reserving
unto Kansas City an easement and license or right to locate, construct, operate
and maintain facilities including, but not limited to, water, gas, sewerage,
telephone, cable TV, surface drainage, underground conduits, pad mounted
transformers, service pedestals, any and all of them upon, over, under and
along the strips of land outlined and designated on the plat by the words
utility easement or U/E be and the same are hereby accepted and where other
easements are outlined and designated on the plat for a particular purpose, be
and the same are hereby accepted for the purpose as therein set out.
Section 3. That all right, title and interest in
two sanitary sewer easements and one storm sewer easement dedicated by the Plat
of Barrywoods Crossing passed by City Council, by Ordinance No. 961083 on
August 29, 1996, recorded under Document No. 0014292, Book 853, page 73, on
October 16, 1996, be and the same is hereby released to the respective owner,
their successors or assigns, over that part of aforesaid easement described as
follows:
All the part Southwest Quarter of Section 7,
Township 51, Range 33, in Kansas City, Platte County, Missouri, more
particularly described as follows:
A tract of land 10.00 feet in width, lying 5.00 feet
on each side of the following described centerline:
Sanitary Easements: Commencing at the northeast
corner of Lot 5 of Barrywoods Crossing, a subdivision of land in Kansas
City, Platte County, Missouri; thence South 00 59'00" West along the
east line of said Lot 5, a distance of 228.36 feet; thence North 89
01'00" West, a distance of 73.60 feet, to the point of beginning;
thence South 60 58'49" West, a distance of 34.63 feet; thence South
00 59'00" West, a distance of 300.39 feet, to the point of
termination. Containing 3,350 square feet, more or less.
Sanitary Easement: Commencing at the northeast
corner of Lot 5, of Barrywoods Crossing, a subdivision of land in Kansas
City, Platte County, Missouri; thence South 00 59'00" West along the
east line of Lot 5, a distance of 252.99 feet; thence South 00 43'01"
West along the east line of said Lot 5, a distance of 214.75 feet; thence
South 43 58'31" East along the easterly line of said Lot 5, a distance of
53.75 feet, to a point of curvature; thence along a curve to the right,
having a radius of 321.00 feet and a central angle of 17 00'00", a
distance of 95.24 feet, to a point of tangency; thence South 26
58'31" East along the easterly line of said Lot 5, a distance of said
22.70 feet, to a point of curvature; thence along a curve to the right, having
a radius of 15.00 feet and a central angle of 88 38'37", a distance of
23.21 feet, to a point of reverse curvature and the northwesterly right of
way line of N.W. Barrybrooke Drive; thence along a curve to the left of
said right of way line, having a radius of 550.00 feet and a central angle
of 60 41'06", a distance of 582.53 feet, to a point of tangency;
thence South 00 59'00" West along said right of way, a distance of 162.06
feet to the southeast corner of said Lot 5; thence North 89 01'00"
West along the southerly line of said Lot 5, a distance of 205.20 feet;
thence North 00 58'59" East, a distance of 176.36 feet; thence North
89 01'01" West, a distance of 39.76 feet, to the point of beginning;
thence continuing North 89 01'01" West, a distance of 30.80 feet, to the

Storm Easement: Commencing at the northeast corner
of Lot 5 of Barrywoods Crossing, a subdivision of land in Kansas City,
Platte County, Missouri; thence North 89 01'00" West along the north
line of said Lot 5, a distance of 30.00 feet; thence South 00 59'00"
West along a line that is 30.00 feet westerly from a parallel to the east
line of said Lot 5, a distance of 190.10 feet; to the point of beginning;
thence South 45 58'59" West, a distance of 67.14 feet; thence South
00 59'00" West, a distance of 215.12 feet; thence 32 57'02"
East, a distance of 236.63 feet, to the point of termination. Containing
5,189 square feet, more or less.
Section 4. That the Council finds that the City
Plan Commission has duly endorsed its approval of this Ordinance hereon.
