COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 200179

 

Authorizing the City Manager to execute a funding agreement and a prioritization agreement with the Tax Increment Financing Commission for improvements to Route 152 and Platte Purchase Interchange and infrastructure improvements contemplated by the Platte Purchase Redevelopment Plan.

 

WHEREAS Committee Substitute for Ordinance No. 190601 stated the City Council’s support for improvements to the Route 152 and Platte Purchase Interchange and directing the City Manager to work with the Missouri Department of Transportation to prepare applications for the MoDOT Partnership Development Cost Share Program; and

 

WHEREAS, the Cost Share Program awarded the City a $2,732,741.00 cash grant towards the design and construction of the project and an in-kind contribution of $400,082.00 with MoDOT managing the construction and inspection of the project; and

 

WHEREAS, Ordinance No. 160415 approved the Platte Purchase Tax Increment Financing Plan which has since been amended with Ordinance Nos. 170971 and 190264 which is the source of the City’s contribution towards the project; and

 

WHEREAS, Ordinance No. 190455 authorized the execution and delivery of a Financing Agreement among the Tax Increment Financing Commission of Kansas City, Missouri, City of Kansas City, Missouri, Clay County, Missouri, and the Industrial Development Authority of the City of Kansas City, Missouri, which included funding in the amount of $1,700,000.00 towards the total $3,445,739.00 cost of the Interchange; and

 

WHEREAS, in order to accelerate the design and construction of the project to start in the first quarter of 2021, the Second Council District will fund the remaining $1,745,739.00 in fiscal year 2020-2021 which shall be repaid by the TIFC when additional revenue becomes available in the Platte Purchase Tax Increment Financing Plan; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is authorized to execute a funding agreement with the Tax Increment Financing Commission for the purpose of providing funding for improvements to the Route 152 and Platte Purchase Interchange which shall include funding from a Second District In-District PIAC allocation in the amount of $1,745,739.00 in fiscal year 2020-2021 subject to all Code requirements and authorizing ballot language. The agreement is approved in substantial form as that on file in the office of the City Manager, subject to the receipt of all required approvals.

 


Section 2. That the City Manager is authorized to execute a reimbursement prioritization agreement for the construction of infrastructure improvements contemplated by the Platte Purchase Redevelopment Plan. The agreement is approved in substantial form as that on file in the office of the City Manager, subject to the receipt of all required approvals.

 

Section 3. Any financial obligations imposed on the City under these agreements are subject to appropriation of funds by the City Council.
