COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 971653

 

Establishing the Citys federal legislative priorities for the United States Congress in 1998.

 

WHEREAS, the United States Congress will soon convene for its 1998 Session, and the City desires to establish its legislative priorities for the Session; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the City Council of Kansas City hereby adopts the following federal legislative priorities:

 

INTERNET TAXATION

Oppose federal efforts to pre-empt existing state and local taxes applicable to Internet Services

 

RICHARDS-GEBAUR

Support efforts to transition Richards-Gebaur Airport into an international, multi-modal trade compliance center

 

ISTEA

Strongly support the reauthorization of the Federal Transportation Law

- To insure the continued role of federal policy in maintaining national highway standards

- Provide for more equitable distribution of highway funds and flexibility in how these funds can be spent to meet local needs

- Provide input into the legislative or administrative processes as issues dictate

 

FLOOD CONTROL

In light of recent federal announcements decreasing funding to locally sponsored flood control projects, support a concerted effort to seek funding via annual appropriation bills for:

- Blue River - Construction funding

- Dopson Area (Upper Blue River) - Planning and feasibility study funding

- Turkey Creek - Planning and feasibility study funding

- Swope Industrial Park - Planning and feasibility study funding

- Kansas Citys seven Missouri River levees - Planning and feasibility study funding

 

CLEAN WATER ACT REAUTHORIZATION AND ENDANGERED SPECIES ACT REFORM

Support State Revolving Fund funding, nonpoint source controls, codification of the CSO controls over an expanded time frame and federal assistance to allow states to continue administering the 503 Biosolids regulations and program

 


TAKINGS

Oppose H.R. 1534 and S. 1256 which:

- Restrict local land use authority by changing the Supreme Court recognized standards for ripeness

- Increase the volume of litigation and the associate costs for local government

- Transfer local zoning authority on land use decisions to federal courts

 

ENVIRONMENTAL PROTECTION ADMINISTRATION / AIR QUALITY STANDARDS

Encourage the EPA to permit local communities to resolve their air quality problems using whatever methods work best for them

 

TOWN OF KANSAS URBAN ARCHAEOLOGICAL PARK

Support the development of the Town of Kansas Urban Archaeological Park as a national and regional destination for visitors and researchers interested in exploring aspects of pre-history, Native American habitation, early exploration, European immigrant settlement, river boat commerce, westward expansion, the Santa Fe and Oregon Trails, and the Citys historic role in anti-slavery efforts, in order to provide a truly unique tourism opportunity unlike anywhere else in the nation

 

TELECOMMUNICATIONS

Support local governments continued authority to control the use of its rights of way by telecommunications providers and to issue franchises and collect fees to maintain property; and

 

Urge caution by the Federal Communications Commission in continuing its policy of auctioning portions of the communications spectrum which may endanger public safety by reducing the availability of communications channels for police, fire and ambulance services

 

INTERSTATE HIGHWAY 35 CORRIDOR

Seek designation of an International Trade Compliance Center within the City and encourage the designation of the I-35 corridor as an international trade corridor between Canada and Mexico

 

FEDERAL AVIATION ADMINISTRATION REAUTHORIZATION

Support reauthorization of the FAA and its funding resources, including user fees and ticket taxes

 

COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDING

Support continued appropriation levels and allocation formulae of CDBG and HOME housing programs while maintaining their broad program flexibility to encourage local decision making

 

BLOCK GRANTING / MANDATES / FEDERAL BUDGET DEFICIT

Encourage sufficient funding, during attempts to balance the federal budget, to support all services previously provided at the federal level which are transferred to local jurisdiction to avoid any unfunded or under funded mandates on local government

 

CENSUS 2000

Urge the Census Bureau to provide the most accurate and timely information on population counts, taking care to avoid critical errors and undercounts which would reflect negatively on urban areas, and provide for a process of validation of population counts

 

TRIBAL SOVEREIGNTY

Support the National League of Cities policy position on Tribes and Trust Land which provides that all lands be uniformly regulated and taxed under municipal laws and encourages, through negotiation or statutory changes, to provide that lands newly acquired by Native-American tribes and individuals shall in the future be given corporate, not federal, trust property status

 

DISCOVERY CENTER

Support federal funding for the Missouri Department of Conservation in Kauffman Legacy Park.
