ORDINANCE NO. 000290

 

Declaring the area of approximately 48 acres generally bounded by 75th Street on the north, 77th Street on the south, Prospect Avenue on the west and Cleveland Avenue on the east, to be a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Land Clearance for Redevelopment Authority law and approving the Urban Renewal Plan for the same, said plan to be known as the Fairyland Park Urban Renewal Plan.

 

WHEREAS, Section 99.430, Revised Statutes of Missouri, provides that a legislative body may approve a declaration of blight and approve an urban renewal plan for the same area simultaneously; and

 

WHEREAS, it is desirable and in the public interest that the Land Clearance for Redevelopment Authority of Kansas City, Missouri, submit an Urban Renewal Plan for the area of approximately 48 acres generally bounded by 75th Street on the north, 77th Street on the south, Prospect Avenue on the west and Cleveland Avenue on the east; and

 

WHEREAS, said area is blighted due to the insanitary or unsafe conditions, deterioration of site improvements, and a combination of such factors so as to constitute an economic or social liability to the public health, safety, morals or welfare; and

 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on the 24th day of November, 1999, adopt a resolution recommending that the area be declared blighted and recommending approval of an Urban Renewal Plan for the area of approximately 48 acres generally bounded by 75th Street on the north, 77th Street on the south, Prospect Avenue on the west and Cleveland Avenue on the east, said resolution being set forth and incorporated in the Urban Renewal Plan; and

 

WHEREAS, the City Plan Commission reviewed and recommended approval of the designation of blight and approval of the Urban Renewal Plan on January 4, 2000, as evidenced by its resolution recommending approval of the adoption of said plan and found said plan to be in conformance with the Master Plan for the development of the community as a whole, subject to certain conditions, a copy of which resolution is attached hereto and incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the proposed urban renewal area of approximately 48 acres identified as the Fairyland Park Urban Renewal Plan generally bounded by 75th Street on the north, 77th Street on the south, Prospect Avenue on the west and Cleveland Avenue on the east, and more specifically described as:

 

TRACT A: A tract of land in the North 1/2 of the Northwest 1/4 of Section 15, Township 48 North, Range 33 West, Kansas City, Jackson County, Missouri, said tract being described by metes and bounds as follows: Starting at the City monument marking the northwest corner of Section 15, Township 48 North, Range 33 West, thence South 02E17'08" West along the west line of said Section 15, a distance of


75.02 feet; thence parallel to the north line of said Section 15, South 86E32'59" East, 40.01 feet to the point of beginning of the tract herein described, said point in the south line of 75th Street; thence South 86E32'59" East along south line of 75th Street, a distance of 993.00 feet to a point; thence South 69E51'02" East, 52.20 feet to a point; thence South 25E57'06" East, 753.60 feet to a point being on the north line of 77th Street; thence North 86E30'57" West, 1364.06 feet along the north line of 77th Street; thence North 02E17'08" East, a distance of 1220.85 feet along the east line of Prospect Avenue to the point of Beginning. Containing 35.07 acres, more or less, of land.

 

TRACT C: All that part of the North 1/2 of the Northwest 1/4 of Section 15, Township 48, Range 33, in Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the northwest corner of the Northwest 1/4 of said Section 15; thence South 86E33'00" East along the north line of said 1/4 Section, a distance of 1645.00 feet; thence South 3E27'00" West, a distance of 75.00 feet to a point on the east line of Bruce R. Watkins Drive, as established by General Warranty Deed, Document No. K-720929, in Book K-1554, at page 1307, Jackson County Records, said point being referred to as Point B in said Document; thence South 1E16'37" West along the east line of said Bruce R. Watkins Drive, a distance of 626.21 feet to the southwest corner of a tract of land conveyed by Special Warranty Deed Document No. K-931913, Book K-2039, page 570 and to the point of beginning of the tract of land to be herein described; thence South 86E33'00" East along the south line of said conveyed tract of land, a distance of 974.01 feet (Deed 974.34 feet), to a point on the west line of Indiana Avenue, as now established; thence South 2E14'53" West along the west line of said Indiana Avenue, a distance of 595.50 feet to a point on the north line of 77th Street, as established by Ordinance No. 28143; thence North 86E32'36" West along the north line of said 77th Street, a distance of 839.78 feet to a point on the east line of said Bruce R. Watkins Drive; thence the following courses along the east line of said Bruce R. Watkins Drive; North 70E12'09" West, a distance of 57.72 feet; thence North 11E03'00" West, a distance of 325.35 feet; thence North 1E18'40" East, a distance of 264.22 feet to the point of beginning. Containing 12.956 acres, more or less. (Except that portion known as Tract B)

 

is a blighted area and in need of redevelopment and rehabilitation and is appropriate for an urban renewal project, and that the undertaking by the Land Clearance for Redevelopment Authority of Kansas City, Missouri, of surveys and plans for an urban renewal project of a character contemplated by Section 99.430, Revised Statutes of Missouri, as amended, and the proposed urban renewal area is hereby approved.

 

Section 2. That the Council has duly made the findings necessary for compliance with Sections 99.320 and 99.430, Revised Statutes of Missouri, as amended.

Section 3. That the Urban Renewal Plan which is known as the Fairyland Park Urban Renewal Plan, a copy of which is on file in the office of the City Clerk under Document No. 000291 and which is incorporated herein by reference, is hereby approved.

 

Section 4. That said Urban Renewal Plan is hereby found to be feasible and in conformance with the Master Plan for the development of the community as a whole.
