ORDINANCE NO. 010749

 

Approving an amendment to a previously approved development plan in District GP-2 (General Transient Retail Business) on approximately a 44.8 acre tract of land generally located on the north and south sides of Tiffany Springs Parkway, west of N.W. Prairie View Road. (5985-GP-12)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-2 (General Transient Retail Business) on approximately a 44.8 acre tract of land generally located on the north and south sides of Tiffany Springs Parkway, west of N.W. Prairie View Road, and more specifically described as follows:

 

Part of Lot 2, Executive Hills North, 6th Plat, a subdivision of land in Kansas City, Platte County, Missouri, lying generally southwesterly of Interstate Highway No. 29 and southerly of Tiffany Springs Parkway, described as follows: Commencing at the southwest corner of said Lot 2, thence North 89E46'27" East on the south line of said Lot 2, 223.00 feet to the point of beginning; thence North 0E13'33" West, 271.29 feet to the northeasterly line of said Lot 2, said point also being on the southwesterly right of way line of Interstate Highway No. 29 as established by Document No. 23164, in Book 680, at page 310; thence South 55E21'55" East on said northeasterly lot line and said southwesterly right of way line, 427.16 feet to an angle point in said northeasterly lot line, said point also being on said southwesterly right of way line at a point that is 310.00 feet right of an adjacent to highway centerline Station 583+27.00; thence South 42E47'37" East on said northeasterly lot line and said southwesterly right of way line, 36.84 feet to the southeast corner of said Lot 2; thence South 89'46'27" West on the south line of said Lot 2, 375.43 feet to the point of beginning. (Said Tract B contains 526.38 square feet more or less or 1.208 acres.) Known as Tract B on the Lot Split Certificate Survey Lot 2, Executive Hills North 6th Plat, filed May 5, 1999, in Document No. 8186 in Book B at page 387, Executive Hills North 6th Plat, a subdivision in Kansas City, Platte County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

3. That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 


5. That the developer dedicate additional right of way for N. Conant Avenue (south of Tiffany Springs Parkway) as required by the Department of Public Works so as to provide a total of 80 feet of right of way as measured from the centerline of N. Conant Avenue.

 

6. That the developer improve N. Conant Avenue to secondary arterial street standards as required by the Department of Public Works, including construction of curb, gutter and sidewalks and installation of streetlights.

 

7. That the developer improve N.W. 101st Terrace (to be renamed N. Conant Avenue) to secondary arterial street standards as required by the Department of Public Works, including construction of curb, gutter and sidewalks and installation of streetlights.

 

8. That the developer improve Tiffany Springs Parkway to parkway street standards as required by the Board of Parks and Recreation Commissioners, including construction of curb, gutter and sidewalks and installation of streetlights.

 

9. That the developer submit a street name signage plan to the Street Naming Committee for approval to rename N.W. 101st Terrace, south of Building D, to N. Conant Avenue.

 

10. That the developer comply with the Kansas City International Airport Height zoning restrictions.

 

11. That the developer grant an Aviation Noise Easement (for each phase) to the City and file same as required by the Aviation Department.

 

12. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

13. That the developer extend water mains as required by the Water Services Department.

 

14. That the developer extend sanitary sewers as required by the Department of Public Works.

 

15. That the developer provide for fire protection as required by the Fire Department.

16. That the developer provide cross-access easements as required by the Department of Public Works.

 

17. That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming and signage.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 010749, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
