Amending
Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0548,
rezoning an area of approximately 22 acres generally located on the south side
of Blue Parkway between Jackson Avenue (extended) on the west and Elmwood
Avenue (extended) on the east from Districts C-2 (Local Retail Business), CP-2
(Local Planned Business Center), R-2b (Two-Family Dwellings) and RP (Automobile
Parking) to District URD (Urban Redevelopment District), and approving a
development plan for the same. (12874-URD)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri,
commonly known as the Zoning Ordinance, is hereby amended by enacting a new
section to be known as Section 80-11A0548, rezoning an area of approximately 22
acres generally located on the south side of Blue Parkway between Jackson
Avenue (extended) on the west and Elmwood Avenue (extended) on the east from
Districts C-2 (Local Retail Business), CP-2 (Local Planned Business Center),
R-2b (Two-Family Dwellings) and RP (Automobile Parking) to District URD (Urban
Redevelopment District), said section to read as follows:
Section
80-11A0548. That an area legally described as:
A
tract of land in parts of Sections 26, 27, 34 and 35, Township 49 North, Range
33 West, in Kansas City, Jackson County, Missouri, comprising all of Block 2 -
Resurvey of Perwin Place, a subdivision in said City, County and State, parts
of Blocks 1, 3 and 4 in said Resurvey of Perwin Place, all of Tract A,
Sheraton Estates, a subdivision in said City, County and State, along with
parts of vacated 50th Terrace, 51st Street, Elmwood Avenue and Jackson Avenue,
described as follows: Beginning at the southeast corner of the Southeast 1/4
of the Southeast 1/4 of said Section 27; thence North 2E3458
East (bearings are Missouri Coordinate System of 1983, West Zone) along the
east line of the Southeast 1/4 of the Southeast 1/4 of said Section 27, being
also partially along the East line of Lot 1, Blue Parkway Town Center, Second
Plat, a subdivision in said City, County and State, and being also the west
line of the Southwest 1/4 of the Southwest 1/4 of said Section 26, a distance
of 546.65 feet along said lines, to the northeast corner of said Lot 1, said
point being on the southerly right-of-way line of Relocated Blue Parkway, as
established by the Kansas City, Missouri, Parks And Recreation Department;
thence easterly along said right-of-way line, and along a curve to the left
having a radius of 1175.00 feet, a central angle of 11E4459
and an initial tangent bearing of South 77E1933 East, a distance of 240.96 feet to
a point of tangency; thence South 89E0433 East (South 89E0501
East, record) along said southerly line, a distance of 697.37 feet to an angle
point in said line; thence South 85E4851 East, a distance of 349.37 feet
(South 85E4919 East, a distance of 349.41 feet,
record) along said southerly line, to a point on the west right-of-way line of
said vacated Elmwood Avenue; thence
continuing along said southerly line,

61.02 feet to a point on the east line of said vacated Elmwood Avenue; thence

line, a distance of 365.93 feet to the southwest corner of Lot 36, Bluebanks, a
subdivision in said city, county and state; thence North 87E0814 West, a distance of 61.00 feet to
a point on the west line of said vacated Elmwood Avenue; thence South 2E2613 West along said west line, being
also the east line of Block 1 in said Perwin Place, a distance of 145.00 feet
to the southeast corner of said Block 1, said point being also on the north
right-of-way line of 51st Street; thence North 87E2623
West along said line, being also the south line of said Block 1, a distance of
603.70 feet (603.30 feet, Plat) to the southwest corner of said Block; thence
South 2E3323 West along the
prolongation of the west line of said Block 1, a distance of 60.00 feet to a
point on the south line of said 51st Street, being also the north line of Lots
25 and 24, Block 6 in said Sheraton Estates; thence North 87E2623 West (North 89E5944 West, Plat) along said lines, a
distance of 75.91 feet to the most northeasterly corner of Tract A in said
Sheraton Estates; thence South 42E2245
West along the easterly line of said TractA, being also the northwesterly
line of Lots 16 through 19, and 24 in said Block 6, a distance of 429.67 feet
to the northwest corner of Lot 19 in said Block 6; thence South 12E2614 East along the southerly line of
said Tract A, being also the southwesterly line of said Lot 19, a distance of
135.28 feet to the southwest corner of said Lot 19; thence southwesterly along
the southerly line of said Tract A, being also the northerly right-of-way
line of 52nd Street, and along a curve to the right having a radius of 539.20

West, a distance of 52.36 feet (50 feet, Plat) to the southeast corner of Lot
20 in said Block 6; thence North 35E0818
West along the southerly line of said Tract A, being also the easterly line
of said Lot 20, a distance of 133.28 feet to the northeast corner of said Lot

along the southerly line of said Tract A, being also the northerly line of
Lots 20 through 23 in said Block 6, a distance of 235.48 feet to the northwest
corner of said Lot 23, said point being on the east right-of-way line of
vacated Jackson Avenue; thence North 87E3516
West at right angles to the centerline of said vacated Jackson Avenue, a
distance of 25.00 feet to a point on said centerline, being also the west line
of the Northwest 1/4 of said Section 35; thence North 2E2444 East along said lines, being also the east line of
the Northeast 1/4 of said Section 34, a distance of 503.30 feet to the point of
beginning. The above described tract contains 912,170 square feet, or, 20.9405
acres, more or less, gross, and 883,719 square feet, or 20.2874 acres, more or
less, net, excluding Kensington Avenue right-of-way.
is hereby rezoned from Districts C-2 (Local Retail
Business), CP-2 (Local Planned Business Center), R-2b (Two-Family Dwellings)
and RP (Automobile Parking) to District URD (Urban Redevelopment District), all
as shown outlined on a map marked Section 80-11A0548, which is attached hereto
and made a part hereof, and which is hereby adopted as a part of an amendment
to the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That a development plan for the area
legally described above is hereby approved. A copy of said development plan is
on file in the office of the City Clerk under Document No. 040142, which is
attached hereto and made a part hereof.
Section C. That the Council finds and declares
that before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
