ORDINANCE NO. 951250

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2600 rezoning an area of approximately 48 acres generally located at the northwest corner U. S. Highway 169 and N.W. Barry Road from Districts RA (Agricultural) and CP-3 (Regional Planned Business Center) to District CP-3 (Regional Planned Business Center), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2600, rezoning an area of approximately 48 acres generally located at the northwest corner of U.S. Highway 169 and N.W. Barry Road from Districts RA (Agricultural) and District CP-3 (Regional Planned Business Center) to District CP-3 (Regional Planned Business Center), said section to read as follows:

 

Section 65.010A2600. That an area legally described as:

 

All that part of the Fractional Northwest One-Quarter (1/4), and all that part of the Northeast One-Quarter (1/4) of Section 10, Township 51, Range 33, in Kansas City, Clay County, Missouri, described as follows:

 

Beginning at the southeast corner of said Fractional Northwest One-Quarter (1/4), thence North 89 28'55" West, along the south line of said Fractional Northwest One-Quarter (1/4), a distance of 686.00 feet; thence North 0 35'55" East, a distance of 191.70 feet, to a point of curvature; thence northeasterly along a curve to the right, having a radius of 512.00 feet, a central angle of 21 24'12", a distance of 191.26 feet, to a point of compound curvature; thence continuing northeasterly along a curve to the right, having a radius of 280.00 feet, a central angle of 16 37'53", a distance of 81.28 feet; thence North 51 22'01" West, a distance of 121.09 feet, to a point on a curve; thence along a curve to the right, having an initial tangent bearing of North 16 18'59" West, a radius of 500.00 feet, a central angle of 3 25'42", a distance of 29.92 feet; thence North 15 03'40" East, a distance of 502.34 feet; thence North 74 56'20" West, a distance of 144.39 feet; thence North 0 31'05" East, a distance of 906.62 feet; thence South 89 28'55" East, a distance of 384.37 feet; thence South 15 03'40" West, a distance of 389.09 feet; thence South 74 56'20" East, a distance of 300.00 feet; thence North 75 03'40" East, a distance of 100.00 feet; thence South 74 56'20" East, a distance of 648.90 feet; thence South 86 56'28" East, a distance of 80.00 feet, to a point on a curve; thence southwesterly along a curve to the right, having an initial tangent bearing of South 3 03'32" West, a radius of 690.00 feet, a central angle of 8 05'19", a distance of 97.41 feet; thence South 78 51'09" East, a distance of 366.52 feet, to a point on the westerly right of way line of U.S. Highway Route No. 169, as now established; thence South 25 59'53" West, along said westerly right of way line, a distance of 115.08 feet, thence South 37 32'37" West, continuing along said westerly right of way line, a distance of 281.73 feet; thence South 52 01'01" West, continuing along said westerly right of way line, a distance of 98.41 feet; thence South 46 29'18" West, continuing along said westerly right of way line, a distance of 266.74 feet, to a point of curvature; thence southwesterly continuing along said westerly right of way line and along a curve to the left, having a radius of 420.00 feet, a central angle of 38 11'05", a distance of 279.91 feet; thence South 8 22'15" West, continuing along said westerly right of way line, a distance of 211.32 feet; thence South 28 05'36" West, continuing along said westerly right of way line, a distance of 79.61 feet; thence South 71 13'37" West, continuing along said westerly right of way line, a distance of 105.94 feet; thence South 84 48'28" West, continuing along said westerly right of way line, a distance of 100.50 feet; thence North 89 28'55" West, continuing along said westerly right of way line, a distance of 125.92 feet, to a point on the east line of the aforesaid Fractional Northwest One-Quarter (1/4) of said Section 10; thence South 0 37'00" West, along said east line, a distance of 80.00 feet, to the point of beginning, containing 2,044,682.1082 square feet or 46.9394 acres, more or less.

 

is hereby rezoned from Districts RA (Agricultural) and District CP-3 (Regional Planned Business Center) to District CP-3 (Regional Planned Business Center), all as shown outlined on a map marked Section 65.010A2600, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval for the entire development when the first plat is submitted, including

provision for any needed improvements.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer for approval prior to the commencement of any construction.

 

4. That the developer secure the approval of the Street Naming Committee for all street names.

 

5. That the developer construct temporary cul-de-sacs as required for each phase.

 

6. That the developer extend water mains as required by the Water Services Department.

 

7. That the developer provide for fire protection as required by the Fire Department.

 

8. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

9. That the developer receive the approval of the Missouri Highway and Transportation Department for any work within State right of way.

 

10. That the developer dedicate additional right of way on the north and/or south side of N.W. Barry Road based on the approved traffic study and maintain island widths of

no less than 16 feet.

 

11. That the developer realign N.W. Barry Road between existing N. Madison Avenue and N. Hickory Street as recommended by the approved traffic study, including

frontage in front of the church located immediately west of the west entrance of the

development, provided further, that the developer widen existing medians to allow

for future addition of single or double left turn lanes as required in future phases

while maintaining the existing median width.

 

12. That the developer widen and relocate existing N. Madison Avenue west approximately 180 feet south of N.W. Barry Road and construct a new approach on

N. Madison Avenue north of N.W. Barry Road as approved by the Department of

Public Works.

 

13. That the developer construct the proposed public street within the development to collector street standards and provide for a minimum of two northbound lanes and

three southbound lanes, including two left turn lanes at its intersection with N.W.

Barry Road.

 

14. That the developer construct a second eastbound left turn lane at the southbound U.S. Highway 169 interchange and taper widen section on N.W. Barry Road down to

match existing section west of the existing overpass bridge of U.S. Highway 169.

 

15. That the developer widen the southbound on-ramp to allow the second eastbound left turning vehicle sufficient room to turn and merge with the existing lanes subject to

the approval of the Missouri Highway and Transportation Department.

 

16. That the developer construct traffic signal improvements at the intersections of N.W. Barry Road/N. Madison Avenue and N.W. Barry Road/the west access drive.

 

17. That the developer widen the northbound off-ramp at its intersection with N.W. Barry Road to provide a second left turn lane subject to the approval of the Missouri

Highway and Transportation Department.

 

18. That the developer comply with the height restrictions of Kansas City International Airport Height Zoning Map.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 951250, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
