COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 010786

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0369, rezoning an area of approximately 60 acres generally located on the north side of N.W. Barry Road, approximately 2000 feet east of N. Childress Avenue from District GP-7 (Agricultural and Low-Density Residential Uses) to GP-3 (Regional Business), and approving a development plan for the same. (12468-GP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0369, rezoning an area of approximately 60 acres generally located on the north side of N.W. Barry Road, approximately 2000 feet east of N. Childress Avenue from District GP-7 (Agricultural and Low-Density Residential Uses) to GP-3 (Regional Business), said section to read as follows:

 

Section 80-11A0369. That an area legally described as:

 

A tract of land in the Northwest Quarter of Section 10, Township 51, Range 34, Kansas City, Platte County, Missouri, described as follows: Commencing at the southeast corner of said Northwest Quarter; thence North 00E04'01" East, along the east line of said Northwest Quarter, a distance of 40 feet to a point on the north line of N.W. Barry Road, as now established, said point also being the point of beginning of the tract of land herein to be described; thence North 89E49'58" West, along the north line of said N.W. Barry Road, a distance of 720 feet; thence North 00E55'33" East, a distance of 363 feet; thence North 89E49'58" West, a distance of 120 feet; thence South 00E55'33" West, a distance of 363 feet to a point on the north line of said N.W. Barry Road; thence North 89E49'58" West, along the north line of said N.W. Barry Road, a distance of 26 feet; thence North 00E55'33" East, a distance of 363 feet; thence North 89E49'58" West, a distance of 120 feet; thence North 00E16'13" East, a distance of 958 feet; thence North 89E29'25" West, a distance of 329 feet; thence North 00E11'55" East, a distance of 995 feet; thence North 89E41'30" West, a distance of 712 feet to a point on the south right of way line of Missouri Route 152, as now established; thence North 77E41'53" East, along said south right of way line, a distance of 225 feet; thence North 84E31'03" East, along said south right of way line, a distance of 165 feet; thence North 89E00'50" East, along said south right of way line, a distance of 561 feet; thence South 89E50'32" East, along said south right of way line, a distance of 1067 feet to a point on the east line of said Northwest Quarter; thence South 00E04'01" West, along the east line of said Northwest Quarter, a distance of 2349 feet to the point of beginning. Said tract of land contains 59.79 acres, more or less.

 

is hereby rezoned from District GP-7 (Agricultural and Low-Density Residential Uses) to District GP-3 (Regional Business), all as shown outlined on a map marked Section 80-11A0369, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 


Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

3. That the developer dedicate additional right of way for N.W. Barry Road as required by the Department of Public Works so as to provide 50 feet of right of way as measured from the centerline of N.W. Barry Road.

 

4. That the developer improve the north half of N.W. Barry Road to primary arterial street standards as required by the Department of Public Works, including construction of curbs, gutters, and sidewalks and installation of streetlights.

 

5. That the developer construct a 75-foot eastbound left turn with adequate tapers on N.W. Barry Road as required by the Department of Public Works at such time as Phase I is developed.

 

6. That the developer dedicate additional right of way in the amount of 12 feet on the north side of N.W. Barry Road from the east property line of the development to the proposed public street as shown on the development plan as required by the Department of Public Works so as to provide for a westbound right turn lane on N.W. Barry Road.

 

7. That the developer construct a 130-foot westbound right turn lane with adequate tapers on the north side of N.W. Barry Road as required by the Department of Public Works at such time as Phase I is developed.

 

8. That the developer construct the proposed public street so as to provide two lanes inbound (northbound) and an exclusive right-turn lane and a left-turn (southbound) lane at its intersection with N.W. Barry Road as required by the Department of Public Works at such time as Phase I is developed.

 

9. That the developer enter into an Agreement with the City as required by the Department of Public Works whereby the developer agrees to install a traffic signal at the intersection of the proposed public street and N.W. Barry Road prior to the completion of 75 percent of Phase I of the development.

 

10. That the developer enter into an Agreement with the City as required by the Department of Public Works whereby the developer agrees to construct dual left-turn lanes at the proposed public street at its intersection with N.W. Barry Road at such time as the traffic signal is installed at that location.

 

11. That the developer enter into an Agreement with the City as required by the Department of Public Works whereby the developer agrees to install a traffic signal at the intersection of the proposed public street and the driveway located approximately 1,115 feet north of N.W. Barry Road at such time as the Department of Public Works determines signal is warranted.

 

12. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, as the disturbed area exceeds one acre.

 

13. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

14. That the developer grant an Aviation Noise Easement to the City as required by the Aviation Department with the final plats.

 

15. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

16. That the developer extend sanitary sewers as required by the Department of Public Works.

 

17. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

18. That the developer extend water mains and provide easements as required by the Water Services Department.

 

19. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right-of-way.

 

20. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on grading, landscaping, pedestrian sidewalks, signage (including elevations), and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 010786, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
