ORDINANCE NO. 900402
Approving the preliminary plat of Northland Terrace on a
48 acre tract of land located generally between N. Oak Trafficway and 169
Highway and south of Mid Continent Trafficway.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That the preliminary plat of Northland
Terrace on a 48 acre tract of land located generally between N. Oak Trafficway
and Highway 169 and south of Mid Continent Trafficway, and more specifically
described as follows:
A tract of land in the Northwest Quarter of Section
26, and the Southwest Quarter of Section 23, Township 52, Range 33,
Kansas City, Clay County, Missouri, being bounded and described as
follows:
Beginning at the intersection of the South line of
the Southwest Quarter of said Section 23, with the easterly right of
way line of Arrowhead Trafficway, (U.S. Highway No. 169), as now
established, said point being 47.38 feet East of the Southwest corner of
said Southwest Quarter; thence North 0740'46" East along said right
of way line, a distance of 674.64 feet; thence North 0215'11"
West along said right of way line, a distance of 426.29 feet; thence
northeasterly along said right of way line on a curve to the right, having
a radius of 894.93 feet, an arc distance of 374.87 feet; thence North
3655'57" East along said right of way line, a distance of 329.55
feet; thence North 4732'34" East along said right of way line,
a distance of 198.12 feet; thence northeasterly along said right of way
line on a curve to the left, having a radius of 490.00 feet, an arc
distance of 72.43 feet to a point on the westerly right of way line of N.
Oak Trafficway, as now established; thence South 1728"24"
East along said right of way line, a distance of 1398.14 feet; thence
southeasterly along said right of way line, on a curve to the left, having
a radius of 1082.14 feet, an arc distance of 500.18 feet; thence South
0018'46" West, a distance of 79.00 feet; thence South
6145'40" East along said right of way line, a distance of
908.32 feet; thence North 2814'20" East along said right of way
line, a distance of 20.00 feet; thence South 6145'40" East along
said right of way line, a distance of 124.32 feet to a point on the South
line of the North 383.40 feet of the Northwest Quarter of the above
mentioned Section 26; thence North 8921'09" West along said
South line, a distance of 2177.91 feet to a point on the East right
of way line of said Arrowhead Trafficway; thence North 0130'19" East
along said right of way line, a distance of 255.51 feet; thence North
0740'46" East along said right of way line, a distance of 128.87
feet to the Point of Beginning, containing 48.22 acres more or less.
is hereby approved, subject to the following conditions:
1. That the developer prohibit any structures
erected which would exceed the Kansas City International Airport
height
zoning restrictions.
2. That the developer cause the area to be platted
and processed in accordance with Chapter 31, Code of General
Ordinances of Kansas City, Missouri, as
amended, commonly
known as the Subdivision Regulations and that
the
developer submit a storm drainage study at the
time of
submission of the final plat.
3. That the developer improve the adjacent
one-half of N. Oak Street Trafficway to residential standards,
including
curbs, gutters, sidewalks and streetlights.
4. That the developer construct temporary
cul-de-sacs as required by the City Engineer.
5. That the developer construct a permanent
turnaround at the north end of N. Oak Trafficway.
6. That the developer extend sanitary sewers.
7. That the developer secure the approval of the
Missouri Highway and Transportation Department for any grading
plans and work within State right of way.
8. That the developer pay money in lieu of
parkland dedication in the amount of $20,643.19 based upon 208
single family lots in satisfaction of Section
31.32.
9. That the developer delineate the noise decibel
contours on the plat and prohibit construction of any single
family units with the 65 decibel contour.
10. That the developer submit an Aviation and Noise
Easement.
11. That the developer extend water mains as
required.
12. That the developer install hard surface roads
and fire hydrants before construction proceeds beyond footings and
foundations.
A copy of the preliminary plat is on file in the
office of the City Clerk under Document No. 900402, which is attached hereto
and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed preliminary plat hereinabove, all
public notices and hearings required by the Subdivision Regulations have been
given and had.
