ORDINANCE NO. 030577

 

Approving the plat of Hunters Glen Third Plat, an addition in Kansas City, Clay County, Missouri; accepting various easements; establishing grades on public ways; accepting certain lands for park purposes forever, in accordance with Section 58 of Article III of the Charter of Kansas City; authorizing the Director of Public Works to execute certain agreements; and authorizing the City Clerk to file this ordinance and attached agreement.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Hunters Glen Third Plat, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

 

Section 4. That the lands heretofore designated and selected by the Board of Parks and Recreation Commissioners as evidenced by their Resolution No. 25815 duly adopted on April 22, 2003, for public use for park purposes, to-wit:

 

A tract of land in the North Half of the Southwest Quarter of Section 23, Township 52 North, Range 32 West, in Kansas City, Clay County, Missouri, more particularly described as follows: Beginning at a point on the south line of the North Half of said Southwest Quarter, said point being the southeast corner of Tract A, Hunters Glen Second Plat, a subdivision in said City, County, and State: thence North 00E29'54" East, along the east line of said Hunters Glen Second Plat, 297.27 feet; thence South 71E21'47" East, 92.34 feet; thence South 73E50'17" East, 67.11 feet; thence North 84E03'11" East, 67.11 feet; thence North 61E56'38" East, 67.11 feet; thence North 39E50'06" East, 67.11 feet; thence North 74E51'37" East, 52.06 feet; thence South 15E08'23" East, 36.93 feet; thence South 02E25'35" West, 75.13 feet; thence South 16E50'36" East, 67.11 feet; thence South 38E57'08" East, 67.11 feet; thence South 61E03'40" East, 67.11 feet; thence South 83E10'13" East, 67.11 feet; thence North 74E43'15" East, 67.11 feet; thence North 52E36'42" East, 67.11 feet; thence North


30E30'10" East, 67.11 feet; thence North 08E23'37" East, 67.11 feet; thence North 27E14'25" West, 82.32 feet; thence North 52E20'58" East, 269.25 feet, to a point on the east line of the North Half of said Southwest Quarter; thence South 00E19'17" West, along said east line, 513.30 feet, to the southeast corner of the North Half of said Southwest Quarter; thence North 89E30'06" West, along the south line of said North Half, 901.79 feet, to the point of beginning.

 

Containing 5.35 acres, more or less be and the same is hereby accepted for public use for park purposes and shall remain such forever in accordance with Section 58 of Article III of the Charter of Kansas City.

 

Section 5. That the Director of Public Works is hereby authorized to execute a Subordination of License or Easement Agreement with BP Products North America, a Maryland corporation, and with Robertson Properties, Inc., a Missouri corporation, to be in a form substantially as that attached hereto as Exhibit "A" and incorporated herein by reference.

 

Section 6. That the City Clerk is hereby directed to file copies of this ordinance, together with the Subordination of License or Easement Agreement with BP Products North America, a Maryland corporation, and with Robertson Properties, Inc., a Missouri corporation, in the Office of the Secretary of State of Missouri and in the Office of the Recorder of Deeds of Clay County, Missouri together with all other relevant documents.

 

Section 7. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
