RESOLUTION NO. 981092

 

Approving an amendment to the Garfield/Independence Plaza Area Plan, being that part of Kansas City bounded by the Missouri Pacific Railroad Tracks, I-35, I-70 and Prospect Avenue, modifying the Land Use Plan and Map for an area generally located south of 12th Street, between Woodland Avenue and Michigan Avenue, to recommend medium density residential uses instead of retail commercial uses. (201-S-3)

 

WHEREAS, by Resolution No. 46636 adopted January 28, 1977, the City adopted the Garfield/Independence Plaza Area Plan as a guide for development and redevelopment of that area generally bounded by the Missouri Pacific Railroad Tracks, I-35, I-70 and Prospect Avenue; and

 

WHEREAS, said Garfield/Independence Plaza Area Plan was amended on April 15, 1993, through the adoption of Resolution No. 930263; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Garfield/Independence Plaza Area Plan as it affects that area generally located south of 12th Street, between Woodland Avenue and Michigan Avenue, by modifying the Proposed Land Use Plan and Map for such area from retail commercial uses to medium density residential uses; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on July 20, 1998; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on August 4, 1998; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on August 4, 1998, recommend approval of the proposed amendment to the Garfield/Independence Plaza Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the second amendment to the Garfield/Independence Plaza Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area generally located south of 12th Street, between Woodland Avenue and Michigan Avenue, by modifying the recommended land uses for the area from retail commercial uses to medium density residential uses. A copy of the amended Land Use Plan and Map is attached hereto as Exhibit A and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
