COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 130596 

Reducing appropriations in the General Fund in the amount of $229,507.61; appropriating that amount from the Unappropriated Fund Balance of the General Fund to the Dangerous Building Demolition, Paint Program and Housing Division accounts; and designating the Director of Neighborhoods and Housing Services as the requisitioning authority.

WHEREAS, on September 9, 2010, Council approved Ordinance No. 100742 which appropriated the sum of $229,507.61 and authorized a funding agreement pursuant to which this sum was to be held until May 11, 2013, in the event that MAC Healthcare or one of its affiliated entities caused the completion of removal of any remaining demolition debris and asbestos on the development site and sought reimbursement for such removal as part of the development of the 2715 Swope Parkway parcel; and

WHEREAS, the removal of any remaining demolition debris and asbestos on the 2715 Swope Parkway site was neither started nor completed by May 11, 2013 and, pursuant to the funding agreement, the City’s obligation to continue to set aside these funds automatically terminated; and

WHEREAS, the Director of Finance was thereby authorized to close this project account upon project completion and return the unspent portion of the appropriation to the Fund Balance from which it came from; and

WHEREAS, the following three uses of these funds have been identified: funding of additional demolition and board-up of dangerous buildings, additional funding of the paint program and funding of an indemnification agreement with the Curators of the University of Missouri to further the Beacon Hill Student Housing Project; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 Section 1. That the appropriation in the following account of the General Fund is hereby reduced by the following amount: 

14-1000-642024-B 2715 Swope Prkwy Demo/Asbestos $229,507.61 

Section 2. That the amount of $229,507.61 is hereby appropriated from the Unappropriated Fund Balance of the General Fund into the following accounts of the General Fund: 

14-1000-571005-B Housing Division $ 50,000.00

14-1000-572520-B Paint Program 75,000.00

14-1000-572340-B Dangerous Building Demolition 104,507.61

$229,507.61

Section 3. That the Director of Neighborhoods and Housing Services is designated as the requisitioning authority for Account Nos. 14-1000-571005-B, 14-1000-572520 and 14-1000-572340.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
