WHEREAS, Kansas City, through its Aviation Department, has operated the Kansas City International Airport since its inception in 1972; and

WHEREAS, Kansas City International Airport currently is served by fourteen commercial passenger and cargo Airlines under the Airports Use and Lease Agreement between the Airlines and the City, dated September, 1969; and

WHEREAS, Kansas City is experiencing a robust economy, assisted in large part by the role of the Airlines operating at Kansas City International Airport; and

WHEREAS, throughout the past year, the Airlines and the City have been engaged in negotiations for a new Amended and Restated Use and Lease Agreement that became effective on June 1, 1998; and

WHEREAS, in recognition of the Airlines significant contributions to the strength of the local economy and in compliance with Federal regulations requiring that the City treat all Airlines equally, the City wishes to excuse all Airlines from any initial security deposition requirements pursuant to the Amended and Restated Use and Lease Agreement between the City of Kansas City and the Airlines; and

WHEREAS, any subsequent security deposit requirements in addition to the initial security deposit requirement pursuant to the Amended and Restated Use and Lease Agreement shall remain in effect as negotiated by the parties; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
