COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 130071

 

Rezoning an area of about 1.3 acres generally located at the southeast corner of N. Oak Trafficway and N.E. L.P. Cookingham Drive, from Districts B3-2 and R-7.5 to District B1-1. (10577-P-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0925, rezoning an area of approximately 1.3 acres located at the southeast corner of N. Oak Trafficway and N.E. L.P. Cookingham Drive, from Districts B3-2 (Community Business dash 3) and R-7.5 (Residential dash 7.5) to District B1-1 (Neighborhood Business dash 1), said section to read as follows:

 

Section 88-20A0925. That an area legally described as:

 

A part of the Southeast Quarter of Section 23, Township 52 North, Range 33 West, in the City of Kansas City, Clay County, Missouri, more particularly described as follows: Commencing at the Northwest Corner of said Southeast Quarter; thence South 89 degrees 11 minutes 29 seconds East, coincident with the North line of said Southeast Quarter, 30.30 feet; thence South 00 degrees 48 minutes 31 seconds West, 40.00 feet to a point on the South right-of-way line of Cookingham Drive, as it now exists, said point being the point of beginning; thence South 89 degrees 11 minutes 29 seconds East, coincident with said South right-of-way line and parallel with the North line of said Southeast Quarter, 264.00 feet; thence departing said South right-of-way line, South 00 degrees 22 minutes 32 seconds West, parallel with the West line of said Southeast Quarter, 186.14 feet; thence North 89 degrees 11 minutes 29 seconds West, parallel with the North line of said Southeast Quarter, 142.00 feet; thence South 00 degrees 22 minutes 32 seconds West, parallel with the West line of said Southeast Quarter, 62.86 feet; thence North 89 degrees 11 minutes 29 seconds West, parallel with the North line of said Southeast Quarter, 122.00 feet to a point on the East right-of-way line of North Oak Trafficway, as it now exists; thence North 00 degrees 22 minutes 32 seconds East, coincident with said East right-of-way line and parallel with the West line of said Southeast Quarter, 249.00 feet to the point of beginning, containing 56,808 square feet, or 1.304 acres, more or less.

 

is hereby rezoned from Districts B3-2 (Community Business dash 3) and R-7.5 (Residential dash 7.5) to District B1-1 (Neighborhood Business dash 1), all as shown outlined on a map marked Section 88-20A0925, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That the rezoning is subject to the following condition:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, prior to the issuance of an occupancy permit.

 

2.                  That a development plan for this property, including elevations and landscaping plan, is hereby approved, and a building permit may only be issued that is in substantial conformance with this plan, subject to the following modifications:

 

a.                   That the developer revise the plan to ensure that the location of the driveway on N. Oak Trafficway in relation to the existing homes on the west side of N. Oak Trafficway is properly situated so as to prevent direct headlamp lights from vehicles exiting the site per staff approval.

 

b.                  That the developer revise the plan to include a sidewalk on the east side of N. Oak Trafficway.

 

c.   That the developer revise the north elevation of the building (along N.E. Cookingham Drive) to show up to four faux windows, per staff approval. 

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
