COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 170569

 

Calling an election on November 7, 2017 for the purpose of submitting to the voters of Kansas City a question presented by a committee of petitioners through an initiative petition seeking to authorize the City to construct a new, single terminal at Kansas City International Airport with all costs paid solely from the revenues derived by the City from the operation of its airport and related facilities, but allows the City to retain fee title to and operational control of the Airport, and to demolish such existing structures at Kansas City International Airport necessary for the construction or no longer needed for airport operations, without impeding the ongoing operations of the airport.

WHEREAS, a Committee of Petitioners has submitted an initiative petition seeking to authorize the City to construct a new, single terminal at Kansas City International Airport (“KCI”) under a plan that uses privately-arranged financing and incurs no additional City debt, but allows the City to retain fee title to and operational control of the Airport, and to demolish such existing structures at KCI necessary for the construction or no longer needed for airport operations, without impeding the ongoing operations of the airport; and

 

WHEREAS, Section 6-50, Code of General Ordinances of the City, requires that certain activities, including any proposed demolition or replacement of an existing passenger terminal at KCI or the construction of any new passenger terminal at KCI, be presented to the voters of the City for their consideration and approval before any such actions are taken; and

 

WHEREAS, the City Clerk has certified 1,757 valid signatures, thus exceeding the 1,708 required by the City Charter for a successful initiative petition during the period August 1, 2015 through July 31, 2019; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. ELECTION CALLED. That an election is called on November 7, 2017 for the purpose of submitting to the voters of Kansas City the question of whether the voters wish to authorize the City to construct a new, single terminal at KCI with all costs paid solely from the revenues derived by the City from the operation of its airport and related facilities .

 

Section 2. NOTICE TO ELECTION AUTHORITIES BY CITY CLERK. That following passage of this ordinance the City Clerk shall deliver certified copies of this ordinance and notice of election to the Clerk of Cass County, Board of Election Commissioners of Clay County, Board of Election Commissioners of Kansas City, and Board of Election Commissioners of Platte County, on or before August 29, 2017 which shall be the authority of each election authority of the City to submit the question to the electors of Kansas City and give public notice as provided by law.

 

Section 3. NOTICE OF ELECTION. The notice of election shall read as follows:

KANSAS CITY, MISSOURI

 

Notice is hereby given that the City of Kansas City has called a special election to be held on Tuesday, November 7, 2017 between the hours of 6:00 a.m. and 7:00 p.m., at which election all qualified voters residing within Kansas City, Missouri will be given the opportunity to vote.

 

The official ballot will be in substantially the following form:

SPECIAL ELECTION, ____________

 

QUESTION NO. _____

(Initiative Petition)

(KCI Single Terminal)

 

 Shall the City of Kansas City be authorized to construct a new, single terminal at Kansas City International Airport with all costs paid solely from the revenues derived by the City from the operation of its airport and related facilities, but allows the City to retain fee title to and operational control of the Airport, and to demolish such existing structures at Kansas City International Airport necessary for the construction or no longer needed for airport operations, without impeding the ongoing operations of the airport.

A full and complete copy of this ordinance (as it may be amended) submitting the above questions to the electorate is on file in the office of the City Clerk of Kansas City, Missouri where the same is open for inspection and copying.

Section 5. ELECTION REQUIREMENT. If the voters of the City adopt this ordinance, such adoption shall be deemed to satisfy the requirements of Section 6-50, Code of General Ordinances, that a majority of the voters of the City approve the question of the demolition, replacement, or construction of a passenger terminal at KCI.

 

Section 6. ACCELERATED EFFECTIVE DATE RECOGNIZED. This ordinance, providing for the submission of a question to the people of Kansas City, Missouri, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(A) of the City Charter, and shall take effect in accordance with Section 503.
