COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 990608
Calling
for submission to the qualified voters of Kansas City, at a special election to
be held on August 3, 1999, a question authorizing the Council of Kansas City to
increase the alcoholic beverage employee permit fee, increase the application
fee for a new alcoholic beverage license, increase the application fee for a
new alcoholic beverage 3:00 a.m. closing permit; increase the application fee
for the expansion of a retail alcoholic beverage premises; increase the annual
renewal fee for adult entertainment and adult live entertainment business
licenses; establish an application fee for a new amusement license for haunted
houses, dance halls, carnivals, rodeos, street shows, races with motor-propelled
vehicles; establish an inspection fee for haunted houses, dance halls,
carnivals, rodeos, and races with motor-propelled vehicles; establish an
application fee for a new business license for body painting artists and nude
modeling studios; increase the annual fee for a commercial vehicle drivers
certificate; increase the annual permit fee for taxicabs, liveries and
sightseeing vehicles, per vehicle; and establish an inspection fee for
taxicabs, liveries and sightseeing vehicles; directing the City Clerk to notify
the responsible election authorities of the election; recognizing this
ordinance to be an emergency measure; and declaring the effective date of the
authorization.
WHEREAS,
a special election may be held throughout the City on August 3, 1999; NOW,
THEREFORE,
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
1. That an election is hereby called for submitting to the voters of Kansas
City the question of authorizing the Council to increase the alcoholic beverage
employee permit fee, increase the application fee for a new alcoholic beverage
license, increase the application fee for a new alcoholic beverage 3:00 a.m.
closing permit; increase the application fee for the expansion of a retail
alcoholic beverage premises; increase the annual renewal fee for adult
entertainment and adult live entertainment business licenses; establish an
application fee for a new amusement license for haunted houses, dance halls,
carnivals, rodeos, street shows, races with motor-propelled vehicles;
establish an inspection fee for haunted houses, dance halls, carnivals, rodeos,
and races with motor-propelled vehicles; establish an application fee for a new
business license for body painting artists and nude modeling studios; increase
the annual fee for a commercial vehicle drivers certificate; increase the
annual permit fee for taxicabs, liveries and sightseeing vehicles, per vehicle;
and establish an inspection fee for taxicabs, liveries and sightseeing
vehicles. The question shall be submitted to the voters at a special election
to be held on August 3, 1999. If the question is approved, then the Council
may establish or increase the fees up to the following amounts, but not
exceeding at any time, the actual cost of issuing the license or permit or
performing the regulatory functions related to the fee:

Notice is hereby given that Kansas City has called an
election to be held in the City on Tuesday, August 3, 1999, between the hours
of 6:00 a.m. and 7:00 p.m. C. D. T., at which election all qualified voters
residing within Kansas City, Missouri, will be given the opportunity to vote.

Section
3. That upon passage of this ordinance the City Clerk shall immediately
deliver certified copies of this ordinance and notice of election to the Board
of Election Commissioners of Kansas City, Missouri, to the Board of Election
Commissioners of Clay County, Missouri, to the Board of Election Commissioners
of Platte County, Missouri, and to the Clerk of the County Commission of Cass
County, Missouri.
Section
4. This ordinance, providing for the submission of a question to the people of
Kansas City, Missouri, is recognized to be an emergency measure within the
meaning of Section 15, Article II, of the Charter of the City, and as such
becomes effective immediately upon its passage.
Section
5. If a majority of the qualified voters voting at the election shall vote in
favor of the approval of the question, then the authority of the Council to
adopt ordinances imposing the fees shall become effective immediately upon
certification of the election results by the election authorities.
