COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 201071

 

Directing the City Manager to introduce ordinances for Central City Economic Development Sales Tax projects recommended by the CCED Board within 30 days of Board action and to execute contracts for Central City Economic Development Sales Tax Projects within 90 days of Council approval for projects less than or equal to $500,000.00, and within 180 days for projects greater than $500,000.00.

WHEREAS, Section 67.1305 of the Revised Statutes of Missouri authorizes the City to impose a retail sales tax not to exceed one-half of one percent if the imposition of such a retail sales tax is submitted to, and then approved by, a majority of the votes cast; and

 

WHEREAS, on April 4, 2017, pursuant to authority granted by Section 67.1305, RSMo, a majority of Kansas City, Missouri voters approved a new 1/8 of one percent retail sales tax (“Central City Economic Development Sales Tax”) for funding economic development projects within the area bounded by 9th Street on the north, Gregory Boulevard on the south, Martin Luther King, Jr. Boulevard on the west and Indiana Avenue on the east (“CCED District”); and

 

WHEREAS, pursuant to Section 67.1305, RSMo, the approval of the Central City Economic Development Sales Tax also resulted in the creation of the Central City Economic Development Sales Tax Board (“CCED Board”); and

 

WHEREAS, pursuant to Section 67.1305, RSMo, and Section 68-449 of the City’s Code of Ordinances, the CCED Board is charged with considering economic development projects and plans within the CCED District, including holding public hearings; and

 

WHEREAS, pursuant to Section 67.1305, RSMo, after holding public hearings on economic development projects, the CCED Board is to vote on projects and plans within 30 days of the hearing and make recommendations to Council within 90 days of the hearing; and

 

WHEREAS, pursuant to Section 67.1305, RSMo, the City Council has final determination on use and expenditure of the funds generated by the Central City Economic Development Sales Tax; and

 

WHEREAS, the City Council wishes to receive ordinances to consider projects that the CCED Board has recommended for approval within 30 days of such action by the CCED Board; NOW, THEREFORE;

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 


Section 1. That the City Manager is directed to introduce ordinances regarding the Central City Economic Development Sales Tax projects recommended for approval by the CCED Board within 30 days of the CCED Board taking action to approve such projects.

 

Section 2. That the City Manager is directed to execute all contracts for Central City Economic Development Sales Tax projects approved by the City Council within 90 days of Council approval of each contract for projects less than or equal to $500,000.00, and within 180 days of Council approval of each contract for projects greater than $500,000.00.

 

Section 3. That, if the City Manager is unable to meet the deadlines set forth in Sections 1 and 2 of this ordinance, the City Manager shall submit a written report to the Council stating the reasons for the delay for each delayed project.
