ORDINANCE NO. 031068

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0513, rezoning an area of approximately 2.6 acres generally located 400 feet east of N.E. Searcy Creek Parkway on the north side of N.E. Russell Road from District R-1b (One-Family Dwellings) to District R-5 (High Apartments). (12936-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0513, rezoning an area of approximately 2.6 acres generally located 400 feet east of N.E. Searcy Creek Parkway on the north side of N.E. Russell Road from District R-1b (One-Family Dwellings) to District R-5 (High Apartments), said section to read as follows:

 

Section 80-11A0513. That an area legally described as:

 

All that part of the Southeast Quarter of Section 5, Township 50, Range 32 in Kansas City, Clay County, Missouri, described as follows: Beginning at the southeast corner of said Section 5; thence South 89E24'48" West along the south line of said Southeast Quarter a distance of 400.00 feet; thence North 0E33'12" West parallel to the east line of said Southeast Quarter a distance of 110.00 feet; thence North 64E04'43" East , a distance of 198.08 feet measured, 196.26 feet deeded, to a point 194.76 feet north of the south line and 221.02 feet west of the east line of said Southeast Quarter; thence North 0E33'12" West parallel to and 221.02 feet west of the east line of said Southeast Quarter, a distance of 187.53 feet; thence North 89E24'48" East parallel to the south line of said Southeast Quarter, a distance of 221.02 feet to the east line of said Southeast Quarter; thence South 0E33'12" East along the east line of said Southeast Quarter, a distance 382.89 feet to the point of beginning. Said tract contains 2.566 acres more or less.

 

is hereby rezoned from District R-1b (One-Family Dwellings) to District R-5 (High Apartments), all as shown outlined on a map marked Section 80-11A0513, which is attached hereto and made a part hereof, and which is hereby adopted as part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
