RESOLUTION NO. 170434

 

Approving the Blue Ridge Area Plan as a guide for the future development, redevelopment, and public investment within the area generally bounded by 23rd Street Trafficway on the north, Independence and Raytown city limits on the east, 87th Street on the south and the Blue River and Interstate 435 Highway on the west; amending the Sports Complex Area Plan and Eastwood Hills Neighborhood Plan by deleting the portions of the plans covered by the Blue Ridge Area Plan; and repealing and replacing the Winchester Land Use and Development Plan, the 350 Highway/Blue Parkway Corridor Plan and the Eastgate Land Use and Development Plan. WHEREAS, on January 19, 1973, the City Council by Resolution No. 42009 adopted the Sports Complex Area Plan as a guide for development and redevelopment of that area bounded by 23rd Street on the north, Chrysler Avenue on the east, 67th Street on the south, and the Big Blue River on the west; and

 

WHEREAS, said Plan was further amended on July 2, 1996, through the adoption of Resolution No. 960664; and was amended on July 3, 1997, through the adoption of Committee Substitute for Resolution No. 970352; was amended on December 20, 2001, through the adoption of Resolution No. 011678; and was amended on July 11, 2002, through the adoption of Resolution No. 020754; and was amended on July 11, 2002 through the adoption of Resolution No. 020755; and was amended on July 8, 2004 through the adoption of Resolution No. 040663; and was amended on November 17, 2005, through the adoption of Resolution No. 051304; and was amended on July 17, 2008, through the adoption of Resolution No. 080608; and was amended on September 4, 2008, through the adoption of Resolution No. 080782; and was further amended on April 28, 2011, through the adoption of Committee Substitute for Resolution No. 110161; and

 

WHEREAS, on November 17, 2005, the City Council by Resolution No. 051299 adopted the Eastwood Hills Neighborhood Plan as a guide for the future development and redevelopment of the area generally bounded by Raytown Road/Stadium Drive on the north, the Blue River on the west, 55th Street/Blue Parkway on the south and Blue Ridge Cutoff on the east; and

 

WHEREAS, on October 28, 1993, the City Council by Resolution No. 931166 adopted the Winchester Land Use and Development Plan as a guide for the future development and redevelopment of the area generally bounded by 59th Street on the north, 67th Street on the south, Kansas City Southern Railroad on the west, and James A. Reed Road on the east; and

WHEREAS, the City Council amended said plan on December 11, 1997, by Resolution 971416 and further amended said plan on July 17, 2008, by Resolution No. 080608; and

 

WHEREAS, on December 20, 2001, the City Council by Resolution No. 011676 adopted the Eastgate Land Use and Development Plan as a guide for the future development and redevelopment of the area generally bounded by Missouri Pacific Railroad line on the west, Interstate 435 on the east, Coal Mine Road on the north and 63rd Street Trafficway on the south; and

 

WHEREAS, the City Council amended said plan on April 8, 2010, by Resolution No. 091008 and further amended said plan on August 21, 2014, by Resolution No. 140661 and further amended said plan on October 2, 2014, by Resolution No. 140770; and

 

WHEREAS, on July 17, 2008, the City Council by Resolution No. 080608 adopted the 350 Highway/Blue Parkway Corridor Plan as a guide for the future development of the corridor which is generally 1/4 mile on either side of 350 Highway from I-435 on the west to the Raytown city limits on the east; and

 

WHEREAS, after all interested persons were given the opportunity to present testimony, the City Plan Commission did on May 16, 2017, recommend approval of the Blue Ridge Area Plan; and

 

WHEREAS, the stakeholders in conjunction with the City Planning and Development Department have conducted a study delineating the characteristics of the Blue Ridge Area; and

 

WHEREAS, the Blue Ridge Area Plan has incorporated the policies of the FOCUS Kansas City Plan and other appropriate planning documents; and

 

WHEREAS, the policies within the Blue Ridge Area Plan, which will serve as the plan of record for this area, are consistent with the policies of the FOCUS Kansas City Plan, and any future amendments to the Blue Ridge Area Plan should be guided by and comply with the policy direction set forth in the FOCUS Plan; and

 

WHEREAS, as a result of the study, the City Planning and Development Department has proposed a framework for the orderly development and redevelopment within the Blue Ridge Area Plan area; and

 

WHEREAS, said framework provides a guide for future development and redevelopment of the area, for specific and general policies to guide future decisions, and for identification of public and private needs through the community and possible solutions to those needs; and

 

WHEREAS, the City Planning and Development Department has incorporated its findings in the Blue Ridge Area plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Blue Ridge Area Plan is hereby adopted as a guide for the future development and public investments for that area generally bounded by 23rd Street Trafficway on the north, the Blue River Corridor/Interstate 435 on the west, 87th Street on the south, the city limits of Independence and Raytown on the east. A copy of the Blue Ridge Area Plan is attached hereto, in substantial form, and is hereby approved.

 

Section B. That the Sports Complex Area Plan and Eastwood Hills Neighborhood Plan are hereby amended by deleting the portions of the plans covered by the Blue Ridge Area Plan.

 

Section C. That the Winchester Land Use and Development Plan, 350 Highway/Blue Parkway Corridor Plan and Eastgate Land Use and Development Plan are hereby repealed and replaced by the Blue Ridge Area Plan.

 

Section D. That the Blue Ridge Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section E. That the Council finds and declares that before taking any action on the proposed Blue Ridge Area Plan hereinabove, all public notices have been given and hearings have been had as required by law.
