COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 990609

 

Calling for submission to the voters of Kansas City, at a special election to be held on August 3, 1999, a question amending Article IV of the Charter of Kansas City entitled Finance by repealing therein Section 77, Director of finance, Section 79, Division of the treasury and Section 84, Division of revenue, and enacting Sections 77, 79 and 84 of like subject matter to allow the City Council to designate the City departments responsible for the issuance, revocation and suspension of licenses and permits and enforcement of ordinances relating to those licenses and permits; fixing the date when such amendment shall take effect; directing the City Clerk to notify the responsible election authorities of said election; and recognizing this ordinance to be an emergency measure.

 

WHEREAS, a special election may be held throughout the City on August 3, 1999; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That an election is hereby called for the purpose of submitting to the voters of Kansas City an amendment to the Charter of said City. Such question shall be submitted at the special election to be held August 3, 1999.

 

Section 2. That upon passage of this ordinance the City Clerk shall immediately deliver certified copies of this ordinance and notice of election to the Board of Election Commissioners of Kansas City, Missouri, to the Board of Election Commissioners of Clay County, Missouri, to the Board of Election Commissioners of Platte County, Missouri, and to the Clerk of the County Commission of Cass County, Missouri, which shall be the authority of said respective election authorities of the City to submit the amendment to the electors of Kansas City as herein provided and to give public notice thereof as provided by law.

 

Section 3. The notice of election shall read as follows:

Notice is hereby given that Kansas City has called a special election to be held in the City on Tuesday, August 3, 1999, between the hours of 6:00 a.m. and 7:00 p.m. C.D.T., at which election all qualified voters residing within Kansas City, Missouri will be given the opportunity to vote.

 

The official ballot will be in substantially the following form:

Section 4. If a majority of the qualified voters voting at said election shall vote in favor of the question, then an amendment to the Charter of Kansas City, Missouri shall become effective immediately upon certification of the election results by the election authorities, which amendment shall read as follows:

 

BE IT ADOPTED BY THE PEOPLE OF KANSAS CITY:

 

That the Charter of Kansas City, Missouri, adopted February 25, 1925, as amended, is further amended by repealing Section 77, Director of finance, Section 79, Division of the treasury and Section 84, Division of revenue, and enacting sections 77, 79 and 84 of like subject matter to read as follows:

 

Sec. 77. Director of finance.

 

The director of finance shall be appointed by the city manager solely on the basis of integrity, executive ability, and qualifications and experience in finance and accounting. The director shall be charged with the administration of the department of finance and the financial affairs of the city, including the installation, maintenance and supervision of all accounts and financial records; supervision of the collection, custody and disbursement of all city moneys, except that the city manager may authorize the keeping of utility accounting records by any department operating as a public utility, and may authorize the collection by any such department of all moneys due the city from the operation of any such utility; the issuance of licenses when the issuance is not otherwise provided for in the charter or ordinances; the control over expenditures; the purchase, storage and distribution of supplies needed by the city; the sale of city property, real or personal; and shall perform such other duties as may be required by ordinance. In the department of finance there shall be the following divisions: accounts, treasury, purchases and supplies, assessments, revenue, licenses and such other divisions as are now or may hereafter be created by the council.

 

Sec. 79. Division of the treasury.

 

There shall be in the department of finance a division of the treasury for the supervision of which the director of finance shall appoint a city treasurer. The city treasurer shall be charged with the custody of all public moneys of the city and, unless otherwise provided in the charter or ordinances, the collection of all taxes, special assessments, license fees, and all other revenues or moneys payable to or receivable by the city insofar as practicable, except such taxes and special assessments as may be collected by the county collector, and except the collection of public utility revenues by a department operating as a public utility under authorization by the city manager under section 77 of this article, which revenues shall be paid over by such department to the city treasurer, and he shall thereupon be charged with the custody of such revenues. All money received for the city by any other officer or employee of the city shall be paid into the city treasury in accordance with such rules as may be made by the director of finance or by ordinance.

 

Petty cash funds may be established by ordinance in such departments and under such restrictions and conditions as the city council may determine. Change funds may also be established and maintained under such conditions and regulations as may be determined by the director of finance and approved by the city manager.

 

The cash of the city shall be deposited with such responsible banking institutions as will furnish such security as the council may require and as will accept such deposits on the basis most advantageous for the city, in accordance with ordinance. Whenever the funds of the city exceed the amount for which the various city depositories have given security, or there are surplus or reserve funds which, in the judgment of the director of finance, should be invested, and the council shall have authorized the director of finance or city treasurer so to do, the director of finance or city treasurer shall invest such surplus or reserve funds of the city in full faith and credit obligations of the United States Government, of any agency or instrumentality of the United States Government, of the State of Missouri, of any county in which the city is located, or of any school district in Kansas City, Missouri, full faith and credit obligations or revenue bonds of the city; or repurchase agreements, bankers acceptances, certificates of deposit, or the highest-rated investment grade commercial paper, with such restrictions as provided by ordinance. The care and custody of all bonds, securities and instruments representing investments of city funds shall be under the control of the director of finance. Such bonds, securities and instruments must be in the name of the city.

 

Sec. 84. Division of revenue.

 

There shall be in the department of finance, a division of revenue which shall be under the supervision of a commissioner of revenue, who shall be appointed by the director of finance.

 

The commissioner of revenue shall have charge of the issuance, suspension and revocation of all licenses and permits and shall be charged with the enforcement of all ordinances relating thereto, except as otherwise provided by the council by ordinance. The commissioner of revenue shall supervise the collection of any tax measured by earnings and shall be charged with the enforcement of ordinances relating thereto.

 

The commissioner of revenue shall also perform such other duties as may be required by this charter or ordinance.

 

Section 5. This ordinance, providing for the submission of a Charter amendment to the people of Kansas City, Missouri, is hereby recognized to be an emergency measure within the meaning of Section 15, Article II, of the Charter of said City, and as such shall become effective immediately upon its passage.
