ORDINANCE NO. 130160

 

Rezoning a 1.5 acre tract of land, generally located at the intersection of N.E. 39th Street, N. Antioch Road and N.E. Parvin Road, to consider rezoning the tract of land from District R-6 to District B1-1. (14365-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0928, rezoning an approximately 1.5 acre tract of land, generally located at the intersection of N.E. 39th Street, N. Antioch Road and N.E. Parvin Road, to consider rezoning the tract of land from District R-6 (Residential dash 6) to District B1-1 (Neighborhood Business dash 1), said section to read as follows:

 

Section 88-20A0928. That an area legally described as:

 

All of Lots 88, 89, 90, 94, 95, 96 and that part of Lots 91 and 93 lying south of a straight line drawn from the Southeast corner of Lot 91 to the Southwest corner of Lot 93, all in Brookwood, a subdivision in Kansas City, Clay County, Missouri, and all that part of the Quincy, Omaha and Kansas City Railroad Company right of way and vacated Rock Creek Road lying between Lots 88,89,90 in said Brookwood being described as follows; Commencing at the Northwest corner of said Lot 94; thence North 74 degrees 15 minutes 07 seconds East along said straight line between Lots 91 and 93, a distance of 41.44 feet to the Point of Beginning of the herein described tract; thence North 74 degrees 15 minutes 07 seconds East continuing along said straight line a distance of 212.49 feet; thence North 63 degrees 39 minutes 29 seconds East a distance of 130.43 feet to a point of the westerly right of way line of Antioch Road as said right of way now exist; thence Southeasterly along said westerly right of way line on a curve to the right having a radius of 1769.62 feet a central angle of 4 degrees 14 minutes 01 seconds whose initial tangent bearing is South 30 degrees 49 minutes 49 seconds East an arc distance of 132.63 feet; thence South 67 degrees 47 minutes 03 seconds West a distance of 103.82 feet; thence South 17 degrees 19 minutes 07seconds East a distance of 206.98 feet; thence South 70 degrees 17 minutes 54 seconds West along the south line of said Lot 88 a distance of 18.85 feet to the easterly right of way line of Parvin Road as said right of way now exist; thence Northwesterly along said easterly right of way line on a curve to the right having a radius of 596.62 feet a central angle of 19 degrees 40 minutes 23 seconds whose initial tangent bearing is North 68 degrees 35 minutes 08 seconds West an arc distance of 204.85 feet; thence North 48 degrees 54 minutes 45 seconds West continuing along said easterly right of way line a distance of 210.33 feet to the Point of Beginning. Containing 62,918.07 square feet or 1.44 acres more or less.

 

is hereby rezoned from District R-6 (Residential dash 6) to District B1-1 (Neighborhood Business dash 1), all as shown outlined on a map marked Section 88-20A0928, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
