Rezoning approximately 7.61 acres generally located south of Missouri 152 and east of Old Stagecoach Road from District GP-6 and GP-7 to GP-7 and approving a development plan for the same. (13708-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance is hereby amended by adding a new section to be known as Section 80-11A0757, rezoning an area generally located south of Missouri 152 and east of Old Stagecoach Road from District GP-6 (Low Density Residential) and GP-7 (Agricultural, Low Density Residential) to GP-7 (Agricultural, Low Density Residential), and more specifically described as follows:

 

Section 80-11A0757. That an area legally described as:

 

All that part of Tract A, Barry Middle School, a subdivision of land in the Northeast Quarter of Section 9, Township 51 North, Range 33 West, and all that part of the Southeast Quarter of Section 4, Township 51 North, Range 33 West of the Fifth Principal Meridian, Kansas City, Platte County, being bounded and described as follows:

 

Commencing at the Northeast corner of said Tract A, said point being also the Northeast corner of the Northeast Quarter of said Section 9; thence North 8935'33" West, (Plat-North 8936'52" West), along the North line of said Tract A, 264.12 feet, to the True Point of Beginning of the tract to be herein described; thence South 024'39" West, 30.00 feet, to a point on the Northerly right-of-way line of Northwest 87th Street Terrace, as now established; thence North 8935'33" West, (Plat-North 8936'52" West), along said Northerly right-of-way line, 244.82 feet; thence Westerly along said Northerly right-of-way line, on a curve to the left, tangent to the last described course, having a radius of 379.52 feet, a central angle of 2430'54" and an arc length of 162.38 feet, (Plat-162.32 feet); thence South 6554'25" West, (Plat-South 6552'48" West), along said Northerly right-of-way line, 38.76 feet, (Plat-38.73 feet); thence Westerly, along said Northerly right-of-way line, on a curve to the right, tangent to the last described course, having a radius of 753.33 feet, a central angle of 1016'41" and an arc length of 135.14 feet; thence Westerly along said Northerly right-of-way line, on a curve to the left, tangent to the last described course, having a radius of 465.74 feet, a central angle of 1141'14" and an arc length of 95.00 feet to the Southwest corner of Tract A; thence North 2538'08" West (Plat-North 2518'31" West), along the Westerly line of said Tract A, 175.37 feet (Plat-175.34 feet) to the Northwest corner of said Tract A, said corner also being on the South line of line of said Southeast Quarter; thence North 8935'33" West, along said South line, 330.16 feet to a point on the Easterly line of NW Old Stagecoach Road, as now established; thence North 6023'43" West, along said Easterly line, 191.84 feet to a point on the Southerly right-of-way line of relocated Missouri Route 152, as now established, said point being 140.00 feet Southerly of centerline Station 180+97 of said relocated Missouri Route 152; thence Northeasterly, along said Southerly right-of-way line, on a curve to the left, having an initial tangent bearing of North 8217'57" East, a radius of 3,959.72 feet, a central angle of 0602'42" and an arc length of 417.77 feet to a point 140.00 feet Southerly of centerline Station 185+00 of said highway; thence North 8813'40" East, along said Southerly right-of-way line, 214.52 feet to a point 190.00 feet Southerly of centerline Station 185+00 of said highway; thence North 6411'45" East, along said Southerly right-of-way line, 623.75 feet to a point 140.00 feet Southerly of centerline Station 192+96.62 of said highway; thence North 8718'18" East, along said Southerly right-of-way line, 45.00 feet; thence South 024'39" West, 460.29 feet to the True Point of Beginning. Containing 331,492 square feet or 7.61 acres more or less.

 

is hereby rezoned from District GP-6 (Low Density Residential) and GP-7 (Agricultural, Low Density Residential) to GP-7 (Agricultural, Low Density Residential), all as shown outlined on a map marked Section 80-11A0757, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a macro/micro storm drainage study to Development Services for review and acceptance for the entire development when the final plat is submitted, and that the developer construct any improvements as required by Development Services.

 

3.                  That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

4.                  That the developer secure permits to repair or reconstruct existing sidewalks, curbs, gutters, storm sewers, and streetlights as necessary along all development street frontages, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curbs, and gutters are in a good state of repair and meet the requirements, as required by Development Services, prior to recording the plat.

 

5.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

6.                  That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more.

 

7.                  That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

8.                  That the developer extend water mains as required by the Water Services Department.

 

9.                  That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services.

 

10.              That the developer provide access restrictions to prohibit direct vehicular access to M-152 Highway from all lots or units and that the restriction be placed on the Final Plat.

 

11.              That the developer submit covenants, conditions and restrictions to Development Services for review by the Law Department for approval of the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

12.              That the developer submit an application to the Board of Zoning Adjustment for any required variances.

 

13.              That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming, provide a photometric study, showing zero footcandles at the property line, signage, and building elevation drawings.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
