COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060168

 

Approving an amendment to a development plan in District GP-2 (general transient retail business) on a 64.2 acre tract of land generally located on both sides of N. Ambassador Drive between N.W. 101st Terrace and N.W. 104th Street (6517-GP-14)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-2 (general transient retail business) on a 64.2 acre tract of land generally located on both sides of N. Ambassador Drive between N.W. 101st Terrace and N.W. 104th Street, and more specifically described as follows:

 

Lots 2-5 inclusive and Lots 8-10 inclusive, Executive Hills North 2nd Plat, and Tracts 1 and 2 of the Certificate of Survey of Lot 7 Executive Hills North 2nd Plat filed as Document #010455 in Book B at Page 138 on August 3, 1992, and Lot 11, Executive Hills North Lot 11, and Exception Nos. 1, 2 and 3 as shown on the plat of Executive Hills North.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to Development Services for approval for the entire development, and that the developer make any improvements as required by Development Services.

 

3. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

4. That the developer obtain a land disturbance permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping (including on-site canopy shade trees along street frontage with a maximum of 50 feet on center), signage (including elevations), photometric study showing zero footcandles at the property lines and no direct illumination of right of way, and building elevations.

 

7. That the developer comply with the KCI Airport Height zoning restrictions and that the developer include a fair disclosure statement with any real estate transaction.

 

8. That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along all development street frontages as required by Development Services in accordance with Chapters 56 and 64, Code of Ordinances, prior to issuance of a certificate of occupancy.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
