ORDINANCE NO. 191016

 

Authorizing the Director of Public Works to enter into a Redevelopment Agreement with the Tax Increment Finance Commission in the N. Brighton Avenue from N.E. 58th Street to Pleasant Valley Road Construction Project.

WHEREAS, pursuant to the Real Property Tax Increment Allocation Redevelopment Act, Sections 99.800 to 99.865 of the Revised Statutes of Missouri, as amended (the “Act”), the City Council of Kansas City, Missouri (the “Council”) by Ordinance No. 54556 passed on November 24, 1982, and thereafter repealed and amended in certain respects by Committee Substitute for Ordinance No. 911076, as amended, passed on August 29, 1991, Ordinance No. 100089, passed on January 28, 2010, Ordinance No. 130986, passed on December 19, 2013, and Committee Substitute for Ordinance No. 140823, as amended, passed on June 18, 2015 (the “Authorizing Ordinances”) created the Tax Increment Financing Commission of Kansas City, Missouri (the "Commission"); and

WHEREAS, the Council passed Ordinance No. 941443, which accepted the recommendations of the Commission as to the approval of Shoal Creek Parkway Tax Increment Financing Plan (the “Redevelopment Plan” or “Plan”) and the designation of the Redevelopment Area described thereby as an economic development area, and authorized the Commission to take all such action as may be needed to effectuate the Redevelopment Plan; and

WHEREAS, the Tax Increment Finance Commission has agreed to reimburse the City up to $10,500,000.00 in the Redevelopment Agreement for construction cost associated with the Project; and

WHEREAS, the Council passed Ordinance No. 190550, which previously estimated and appropriated revenues in the amount of $10,500,000.00 for the Project; NOW, THEREFORE

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 Section 1. That the Director of Public Works is hereby authorized to enter into a Redevelopment Agreement with the Tax Increment Finance Commission of Kansas City for the N. Brighton Avenue from N.E. 58th Street to Pleasant Valley Road construction project. A copy of the agreement is located in the office of the Director of Public Works.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
