Approving a Community Unit Project on a 228.8 acre tract
of land generally located at the northeast quadrant of Missouri Highway 291 and
N. Stark Avenue. (6056-CUP-4)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That a Community Unit Project on a 228.8
acre tract of land generally located at the northeast quadrant of Missouri
Highway 291 and N. Stark Avenue, and more specifically described as follows:
All that part of Section 26, Township 52, Range 32
in Kansas City, Clay County, Missouri, described as follows:
Beginning at the northwest corner of said Section 26; thence South
8918'49" East along the north line of the Northwest Quarter of said
Section 26, a distance of 2633.06 feet to the northeast corner of the
Northwest Quarter of said Section 26; thence South 8924'18" East
along the north line of the Northeast Quarter of said Section 26, a
distance of 1315.19 feet to the northeast corner of the west one-half of
the Northeast Quarter of said Section 26; thence South 040'08"
West along the east line of the west one-half of the Northeast Quarter of
said Section 26, a distance of 1407.74 feet to a point on the centerline
of a 15 foot Sewer Easement recorded as Document G53889 in Book 1059 at
page 977 in the Recorder of Deeds Office in Clay County, Missouri; thence
South 3206'51" West along said centerline, a distance of 285.69
feet; thence South 5629'21" West along said centerline, a distance
of 432.05 feet; thence South 2813'51" West along said
centerline, a distance of 455.74 feet; thence South 2214'11" West
along said centerline, a distance of 501.21 feet; thence South
5200'21" West along said centerline, a distance of 527.42 feet;
thence South 3622'06" West along said centerline, a distance of 5.79
feet; thence North 8354'24" West, a distance of 296.31 feet; thence
North 5735'46" West, a distance of 307.13 feet; thence North
4510'51" West, a distance of 237.94 feet; thence North
6704'40" West, a distance of 290.51 feet; thence North
6947'03" West, a distance of 232.34 feet; thence North
5605'12" West, a distance of 348.73 feet; thence South

northeasterly line of the right of way of Missouri State Highway No. 291;
thence northwesterly along said right of way line and along a curve
to the left, the initial tangent having a bearing of North 3539'31"
West, having a radius of 5769.58 feet, an arc distance of 914.28 feet to a
point on the west line of Northwest Quarter of said Section 26; thence
North 055'37" East along the west line of the Northwest Quarter of
said Section 26, a distance of 2067.45 feet to the point of
beginning. The above described tract of land contains 228.66 acres, more
or less.
is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 31, Code of General
Ordinances of Kansas City, Missouri, as
amended, commonly
known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study to the City Engineer's Office for approval for the entire
development when the first plat is submitted.
3. That the developer obtain a land disturbance
permit from the Missouri Department of Natural Resources.
4. That the developer dedicate additional right of
way as required for a total right of way of 40 feet as measured
from the centerline of N. Stark Avenue.
5. That the developer dedicate additional right of
way as required for a total right of way of 60 feet as measured
from the centerline of Missouri Highway 291.
6. That the developer dedicate additional right of
way as required for a total right of way of 40 feet as measured
from the centerline of N.E. 112th Street.
7. That the developer improve N. Stark Avenue,
including curb, gutters, sidewalks and streetlights, by widening N.
Stark Avenue to provide 18 feet of pavement
from the
centerline if improved at the time that the
developer to
the west is also improving N. Stark Avenue or
provide a
minimum of two 12 foot lanes.
8. That the developer improve N.E. 112th Street,
including curb, gutters, sidewalks and streetlights, by widening
N.E. 112th Street to provide 18 feet of
pavement from the
centerline if improved at the time that the
developer to
the north is also improving N.E. 112th Street
or provide
a minimum of two 12 foot lanes.
9. That the developer improve Missouri Highway 291
as required by the Missouri Highway and Transportation
Department.
10. That the developer receive the approval of the
Street Naming Committee for all street names.
11. That the developer submit a traffic study for
approval prior to submitting the first plat and make all necessary
public improvements as required by that traffic
study.
12. That the developer receive the approval of the
Missouri Highway and Transportation Department for any work within
State right of way.
13. That the developer construct all perimeter
streets prior to the eighth plat.
14. That the developer submit plans for grading and
siltation and erosion control to the City Engineer for approval
prior to the commencement of any construction.
15. That the developer submit conditions, covenants
and restrictions to the City for approval.
16. That the developer construct hard surface roads
and provide for fire protection as required by the Fire
Department prior to construction beyond
foundations.
17. That the developer construct temporary
cul-de-sacs as required for each phase.
18. That the developer extend water mains as
required.
19. That the developer realign the intersection of
N. Stark Avenue and Missouri Highway 291 and construct the
associated revision to the alignment of the
street at N.
Stark Avenue in Phase 1 as recommended by the
Missouri
Highway and Transportation Department.
A copy of said Community Unit Project plan is on file in
the office of the City Clerk under Document No. 940005, which is attached
hereto and made a part hereof.
Section B. That the Council finds and declares that
before taking any action on the proposed Community Unit Project hereinabove,
all public notices and hearings required by the Zoning Ordinance have been
given and had.
