COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 130676

 

Authorizing the City Manager to execute the fourth amendment of a contract with the Metropolitan Energy Center to enlarge the term, extend the scope and increase the total amount of the contract up to $2,665,045.00, all to further the EnergyWorks KC program.

 

WHEREAS, the City was one of 25 entities nationwide selected by the Department of Energy (“DOE”) to be a recipient of a Better Buildings Program grant and the City has negotiated a revised scope of work consistent with a grant award in the amount of $20,000,000.00 in order to implement the EnergyWorks KC (“EWKC”) program over a three-year period; and

 

WHEREAS, pursuant to Ordinance No. 100787, the City entered into Contract No. EECBG-ARRA-OEQ-2 (the “Contract”) with Metropolitan Energy Center (“MEC”) to effectuate the EWKC program; and

 

WHEREAS, pursuant to Ordinance No. 110657, the City entered into a first amendment to the Contract with MEC to continue the EWKC program; and

 

WHEREAS, pursuant to Ordinance No. 120595, the City entered into a second amendment to the Contract with MEC to continue the EWKC program; and

 

WHEREAS, pursuant to Ordinance No. 130288, the City entered into a third amendment to the Contract with MEC to continue the EWKC program; and

 

WHEREAS, DOE has extended the City’s grant term to March 30, 2014; and

 

WHEREAS, the City desires to amend the Contract with MEC to account for the extended programmatic year and scope; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to execute a fourth amendment to the Contract with MEC to enlarge the term, extend the scope and increase the total contract up to $2,665,045.00, all to further the EWKC program. A copy of the fourth amendment, approved in substantial form, is on file with the Office of Environmental Quality.

 

Section 2. That the City Manager, or his designee, is hereby authorized to expend up to $120,045.00 from previously appropriated funds in Account No. 13-2530-105056-B to satisfy the cost of this amendment.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
