ORDINANCE NO. 951335

 

Approving the preliminary plat of Brian's Ridge located on a 7.9 acre tract of land located east of N. Brighton at proposed N.E. 55th Terrace. (SD 0690B)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Brian's Ridge located on a 7.9 acre tract of land located east of N. Brighton at proposed N.E. 55th Terrace, and more specifically described as follows:

 

All that part of the Northwest Quarter of Section 32, Township 51, Range 32, Kansas City, Clay County, Missouri, described as follows: Beginning at the northwest corner of said Northeast Quarter; thence South 17 51'11" East along the east line of a tract deeded to the United Sons and Daughters of Peace in Book 125 at page 466 in the Recorder of Deeds Office in Clay County, Missouri, a distance of 297.62 feet to a point that is 282.75 feet south of the north line of said Quarter; thence South 89 39'49" East parallel to the north line of said Quarter along the north line of said Edward Hickman tract, a distance of 1081.60 feet more or less to the centerline of Thorton Mill Creek; thence down the centerline of said creek in a northerly direction to its intersection with the north line of said Quarter; thence North 89 39'49" West, a distance of 1245.46 feet more or less to the point of beginning; also all that part of the Northeast Quarter of Section 32, Township 51, Range 32, in Kansas City, Clay County, Missouri, beginning at the northwest corner of said Quarter Section; thence South 0 40'40" in the west line of the Northeast Quarter Section, a distance of 210.7 feet; thence South 89 39'49" East and parallel to the north line of said Quarter Section, a distance of 70.48 feet to a point in the east line of a tract deeded to the United Sons and Daughters of Peace, in Book 125, at page 466 of the Deed Records of Clay County, Missouri; thence North 17 51'11" West along said west line of the tract conveyed to the United Sons and Daughters of Peace, to the northwest corner of said Northeast Quarter of Section 32, Township 51, Range 32, and the point of beginning, except and part in roads, if any. Said tract of land contains 7.9 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval for the entire development, including provision for any needed

improvements.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer for approval prior to the commencement of any construction.

 

4. That the developer secure the approval of the Street Naming Committee for all streets.

 

5. That the developer install hard surface roads and fire protection prior to construction beyond foundations.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources, if required.

 

9. That the developer dedicate a total of 50 feet of right of way as measured from the centerline of N. Brighton.

 

10. That the developer improve one-half of N. Brighton to primary arterial street standards or enter into a cooperative agreement.

 

11. That the developer provide access to the house to the south of the property as required by the City Engineer's Office.

 

12. That the developer vacate portions of N. Rolla as required by the City Engineer's Office.

 

13. That the developer submit a street tree planting plan with the final plat. The spacing and species should meet the City Forester's guidelines.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 951335, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
