COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 140430

Approving the Second Amendment to the General Development Plan for the Washington 23 Area by clarifying the land use provisions and revising the tax abatement provisions.

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri, (the “Authority”) found that the Washington 23 Area, as expanded, to be blighted pursuant to the PIEA Law and recommended to the City Council that said area be designated as a blighted, insanitary or underdeveloped industrial area defined by Section 100.310 (2, 11 and 18), RSMo; and

WHEREAS, said area was declared to be blighted by the City Council through passage of Committee Substitute for Ordinance No. 050412 on April 28, 2005, for the original portion of said area, and through passage of Committee Substitute for Ordinance No. 060770 on August 10, 2006, for the expanded portion of said area; and

WHEREAS, a General Development Plan was approved for the original portion of the area known as the Washington 23 General Development Plan by the City Council through Committee Substitute for Ordinance No. 050412 on April 28, 2005, and the First Amendment to the Washington 23 General Development Plan was adopted for the expanded portion of the area by the City Council through passage of Committee Substitute for Ordinance No. 060770 on August 10, 2006; and

WHEREAS, on April 11, 2014, the Authority adopted Resolution No. 1610 approving an amendment to the General Development Plan for the Washington 23 Plan Area, as amended by Committee Substitute for Ordinance No. 060770 on August 10, 2006 (the “Second Amendment”); and

WHEREAS, the City Plan Commission reviewed and recommended approval of the Second Amendment on June 3, 2014, and has found said plan to be in conformance with the general plan for development of the community as a whole; and

WHEREAS, the Council has determined the Second Amendment necessary and desirable to provide for the redevelopment of the Washington 23 Plan Area; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Second Amendment to the General Development Plan for the Washington 23 Plan Area is hereby approved. A copy of said Second Amendment to the General Development Plan for the Washington 23 Plan Area is attached hereto and incorporated herein by reference with this ordinance.

Section 2. That this Council has duly made the findings necessary for compliance with Sections 100.300 through 100.620, RSMo.

Section 3. That said Second Amendment to the General Development Plan for the Washington 23 Plan Area is hereby found to be feasible and in conformance with the general development plan for the community as a whole.

 

Section 4. That the ad valorem tax exemption benefits as authorized pursuant to said Second Amendment to the General Development Plan for the Washington 23 Plan Area are hereby extended to the Washington 23 Plan Area, subject to the execution of a development agreement with the Authority.
