ORDINANCE NO. 140732

 

Authorizing the Director of City Development to apply for and accept supplemental funding from the U.S. Environmental Protection Agency to increase capitalization of the Kansas City Brownfield Revolving Loan Fund; estimating and appropriating revenue in the amount of $615,760.00 in certain Brownfield Revolving Loan Funds and authorizing the execution of an amended cooperative agreement with the U.S. Environmental Protection Agency.

 

WHEREAS, the City accepted a Brownfields Cleanup Revolving Loan Fund (“Brownfield RLF”) grant in 2000 from the U.S. Environmental Protection Agency (“EPA”) in the amount of $500,000.00 as authorized by Ordinance No. 001210; and

 

WHEREAS, the City in 2007 accepted supplemental funding from the EPA in the amount of $500,000.00 to increase capitalization of the Kansas City Brownfields Revolving Loan Fund as authorized by Ordinance No. 070894; and

 

WHEREAS, the City in 2010 accepted additional supplemental funding from the EPA in the amount of $600,000.00 and American Revitalization and Recovery Act funding in the amount of $560,000.00 to increase capitalization of the Kansas City Brownfields Revolving Loan Fund as authorized by Ordinance No. 100138; and

 

WHEREAS, the City in 2012 accepted additional supplemental funding from the EPA in the amount of $83,081.00 to increase capitalization of the Kansas City Brownfields Revolving Loan Fund as authorized by Ordinance No. 120849; and

 

WHEREAS, the Brownfield RLF grant is an important source of low-interest, partially-forgivable loan capital that can be used to finance the cleanup of abandoned and underutilized properties, to help create jobs and new economic opportunities for economically distressed communities in Kansas City; and

 

WHEREAS, the EPA has offered the City additional supplemental funding in the amount of $415,760.00 for hazardous substances cleanup, and $200,000.00 for petroleum cleanup, amounting to a total of $615,760.00 to increase capitalization of the Kansas City Brownfields Revolving Loan Fund conditional upon the submittal of an application for funding and the execution of an amendment to the existing EPA Cooperative Agreement governing use of the funds; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Director of the Department of City Development is authorized to apply for and accept supplemental Brownfield RLF funding from the EPA in the amount of $615,760.00.

 


Section 2. That revenue in the following account of the Brownfield Revolving Loan Fund is estimated in the following amounts:

 

15-2550-640001-476722-G64BRLF Brownfield Revolving

Loan $415,760.00

15-2550-640001-476722-G64BRLP Brownfield Revolving

Loan - Petroleum) 200,000.00

TOTAL $615,760.00

 

Section 3. That the sum of $615,760.00 is appropriated from the Unappropriated Fund Balance of the Revolving Loan Fund to the following accounts:

 

15-2550-645020-B- G64BRLF Brownfield Revolving Loan

Fund Grant $415,760.00

15-2550-645020-B- G64BRLP Brownfield RLF Grant –

Petroleum 200,000.00

TOTAL $615,760.00

 

Section 4. That the Director of City Development is authorized to enter into an amended cooperative agreement with the U.S. Environmental Protection Agency governing the use of the grant funds. A copy of the amendment, in substantial form is on file in the office of the Director of City Development.
