Approving a Community Unit Project on an approximately 24.18 acre tract of land generally located on the east side of N. Platte Purchase Drive, approximately 145 feet north of N.W. 68th Street. (12447-CUP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 24.18 acre tract of land generally located on the east side of N. Platte Purchase Drive, approximately 145 feet north of N.W. 68th Street, and more specifically described as follows:

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a certificate of survey to the Department of City Development for approval prior to sale of individual units.

 

3. That the developer submit a macro/micro storm drainage study for the entire development to the City Engineers Office for approval when the first plat is submitted and that the developer construct any improvements as required by the City Engineers Office.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer dedicate additional right of way for N. Platte Purchase Drive as required by the Department of Public Works and as shown on the plan so as to provide a minimum of 40 feet of right of way as measured from the centerline of N. Platte Purchase Drive and to transition to future Hidden Lakes Development right of way at the north limits.

 

7. That the developer improve the eastern one-half of N. Platte Purchase Drive to secondary arterial street standards as required by the Department of Public Works, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards and relocation of utilities.

 

8. That the developer modify the existing median in N.W. 68th Street at N. Bedford Avenue so that it is mountable concrete to allow access for emergency vehicles as required by the Fire Department and the Department of Public Works.

 

9. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

10. That the developer provide adequate site distance for each street connection to N. Platte Purchase Drive as required by the Department of Public Works.

 

11. That the developer design and construct all interior streets to City standards as required by the Department of Public Works, including construction of curb, gutter, storm sewers and sidewalks and installation of streetlights.

 

12. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees. Further, that the developer either install said trees within one year of the issuance of the home certificate of occupancy or within two years of the recording of the plat and agree to maintain and guarantee the life of the tree for a period of one year following the installation of the tree(s) as required by the Department of Parks and Recreation or enter into a deferral agreement for the installation, maintenance and guarantee of the trees as required by the Department of Public Works.

 

13. That the developer contribute $14,350.20 in lieu of parkland dedication for 70 duplex units (70 x 3 x 0.006 x $11,389.05) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

14. That the developer obtain a floodplain certificate if any grading is to occur within a floodplain as required by the Department of Codes Administration.

 

15. That the developer show the limits of the 100-year and 500-year floodplains on the final plat as required by the Department of Public Works.

16. That the developer show the lowest opening or elevation or minimum low opening (MLO) of any structure on each lot that abuts a 100-year floodplain area on the final plat as required by the Department of Public Works.

17. That the developer submit a street name signage plan to the Street Naming Committee for review and approval for all street names prior to the submittal of the first final plat.

 

18. That the developer extend water mains as required by the Water Services Department.

 

19. That the developer extend and or relocate water and sewer lines as required by the Water Services Department.

 

20. That the developer extend sanitary sewers and/or storm sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

21. That the developer construct hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

22. That the developer submit covenants, conditions and restrictions to the Law Department for approval for maintenance of any private open spaces and any detention areas with the final plat.

 

23. That the developer construct a temporary off-site cul-de-sac as required by the Department of Public Works.

 

24. That the developer include a statement on the final plats prohibiting vehicular access onto N. Platte Purchase Drive from Lots 2 through 12 and 30 through 33 as shown on the development/preliminary plan as required by the Department of Public Works.

 

25. That the developer include a statement on the final plat regarding the required 50 foot landscaped buffer strip along the rear of Lots 2 through 12 and 30 through 33 and identify the location of the buffer strip on Lots 2 through 12 and 30 through 33 which back onto N. Platte Purchase Drive as required by the Department of Public Works.

 

26. That the developer submit a final plan to the City Plan Commission for approval including plans for landscaping within the 50 foot landscape easement at the rear of lots backing onto N. Platte Purchase Drive, grading, signage, screening, berming, fencing and lighting (provide a photometric study, with the intent that there shall be no direct illumination beyond the property line).

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 031329, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
