ORDINANCE NO. 030166

 

Approving a development plan in District GP-5 (Medium Density Residential) on approximately a 73 acre tract of land generally located on the north side of N.W. Cookingham Drive, approximately 350 feet west of N. Congress Avenue/N.W. Interurban Road (west of Ferrelview). (11966-GP-5)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan in District GP-5 (Medium Density Residential) on approximately a 73 acre tract of land generally located on the north side of N.W. Cookingham Drive, approximately 350 feet west of N. Congress Avenue/N.W. Interurban Road (west of Ferrelview), and more specifically described as follows:

 

North Creek Village, a subdivision in Kansas City, Platte County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit a Certificate of Survey to the Department of City Development for approval prior to sale of individual units.

 

2. That the developer construct sidewalks on one side of the street as required by the Department of Public Works.

 

3. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

4. That the developer secure the approval of the Missouri Department of Transportation for access location onto the frontage road.

 

5. That the developer construct and integrate streetlights into the existing public streetlight system for the frontage road between N.E. Cookingham Drive and the projects main entrance as required by the City Engineers Office.

 

6. That the developer submit amended covenants, conditions and restrictions to the Law Department for approval for maintenance of any private open spaces and/or private streets.

 

7. That the developer submit a final plan to the City Plan Commission for approval, including elevation drawings and plans for grading, landscaping, screening, berming, lighting and signage.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 030166, which is attached hereto and made a part hereof.


Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
