ORDINANCE NO. 990951

To establish Sewer Districts 11037, 11038, and 11039 and reestablish Sewer District 719, and repeal Section 1 of Ordinance No. 23134 passed September 19, 1958, establishing Sewer District No. 719, generally located in the vicinity of 55th Street and Bennington Avenue, all in Sewer Division 11, in Kansas City, Jackson County, Missouri.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That Sewer District 11037, in Sewer Division 11, in Kansas City, Jackson County, Missouri, is hereby established, the boundary line of which is described as follows, to wit:

Beginning at the intersection of the north-south centerline of Section 36, Township 49 North, Range 33 West (said centerline also being the current centerline of Bennington Avenue) and the centerline of Blue Parkway (Missouri Highway No. 350); thence southeasterly along the centerline of Blue Parkway (Missouri Highway No. 350) to the intersection with the easterly prolongation of the north line of Lot 10, Highway Acres; thence westerly along said easterly prolongation and said north line to the northwest corner of said Lot 10; thence continuing westerly to the northeast corner of Lot 1, Block 1, Foster Addition; thence continuing westerly along the north line of said Lot 1 and the westerly prolongation of said north line to the intersection with the north-south centerline of said section; thence southerly along said line to a point which lies 396.0 feet north of the east-west centerline of said section; thence westerly along a line which lies 396.0 feet north of and parallel to the east-west centerline of said section to the intersection with a line which lies 565.0 feet west of and parallel to the north-south centerline of said section; thence northerly along said parallel line a distance of 304.0 feet; thence easterly along a line which is parallel with the east-west centerline of said section a distance of 125.0 feet; thence northerly along a line which is parallel with the north-south centerline of said section a distance of 245.0 feet; thence easterly along a line which is parallel with the east-west centerline of said section a distance of 220.0 feet; thence northerly along a line which is parallel with the north-south centerline of said section a distance of 420.0 feet; thence northeasterly to the point of beginning.

Section 2. That Sewer District 11038, in Sewer Division 11, in Kansas City, Jackson County, Missouri, is hereby established, the boundary line of which is described as follows, to wit:

Beginning at the intersection of the centerline of Blue Parkway (Missouri Highway No. 350) and the easterly prolongation of the north line of Lot 10, Highway Acres; thence southeasterly along said centerline of Blue Parkway (Missouri Highway No. 350) to the intersection with the centerline of 55th Street; thence westerly along the centerline of 55th Street to the intersection with the southerly prolongation of the east line of Lot 6, Block 1, Foster Addition; thence northerly along said southerly prolongation of said east line to the northeast corner of said Lot 6; thence westerly along the north line of said Lot 6 and the westerly prolongation of said north line to

the intersection with the north-south centerline of Section 36, Township 49 North, Range 33 West; thence southerly along said line to the intersection with the east-west centerline of said section (said intersection also being the northeast corner of the Southwest Quarter of Section 36, Township 49 North, Range 33 West); thence westerly along the east-west centerline of said section (platted north lines of Lots 19 through 27, Country Aire Estates) a distance of 695.0 feet; thence northerly along a line which is parallel with the north-south centerline of said section a distance of 350.0 feet; thence easterly along a line which is parallel with the east-west centerline of said section a distance of 130.0 feet; thence northerly along a line which is parallel with the north-south centerline of said section a distance of 46.0 feet; thence easterly along a line which is parallel with the east-west centerline of said section a distance of 565.0 feet to the north-south centerline of said section; thence northerly along said north-south centerline to the intersection with the westerly prolongation of the north line of Lot 1, Block 1, Foster Addition; thence easterly along said westerly prolongation and said north line to the northeast corner of said Lot 1; thence continuing easterly to the northwest corner of Lot 10, Highway Acres; thence continuing easterly along the north line of said Lot 10 and the easterly prolongation of said north line to the point of beginning.

Section 3. That Sewer District 11039, in Sewer Division 11, in Kansas City, Jackson County, Missouri, is here by established, the boundary line of which is described as follows, to wit:

Beginning at intersection of the centerline of 55th Street and the southerly prolongation of the east line of Lot 6, Block 1, Foster Addition; thence southerly along a line which is parallel to the north-south centerline of Section 36, Township 49 North, Range 33 West a distance of 185.0 feet; thence westerly along a line which is parallel to the centerline of 55th Street a distance of 310.0 feet to the north-south centerline of said section; thence southerly along said north-south centerline to the intersection with the centerline of 56th Street; thence westerly along the said centerline a distance of 230.0 feet; thence southerly along a line which is parallel to the north-south centerline of said section a distance of 200.0 feet; thence westerly along a line which is parallel to the centerline of 56th Street a distance of 295.0 feet; thence northerly along a line which is parallel to the north-south centerline of said section a distance of 500.0 feet; thence westerly along a line which is parallel to the east-west centerline of said section a distance of 170.0 feet; thence northerly along a line which is parallel to the north-south centerline of said section to the east-west centerline of said section (said centerline also being the platted north line of Lot 27 through 19, Country Aire Estates); thence easterly along the east-west centerline of said section a distance of 695.0 feet to the north-south centerline of said section; thence northerly along the north-south centerline of said to the intersection with the westerly prolongation of the north line of Lot 6, Block 1, Foster Addition; thence easterly along said westerly prolongation and said north line to the northeast corner of said Lot 6; thence southerly along the east line of said Lot 6 and the southerly prolongation of said east line to the point of beginning.

Section 4. That Sewer District 719 in Sewer Division 11 in Kansas City, Jackson County, Missouri is hereby re-established, the boundary line of which is described as follows, to wit;

Beginning at the intersection of the centerline of Blue Parkway (Missouri Highway No. 350) and the centerline of 55th Street; thence southeasterly along the centerline of Blue Parkway (Missouri Highway No. 350) to the intersection with a line which lies 325.0 feet west of and parallel to the east line of Section 36, Township 49 North, Range 33 West; thence southerly along said parallel line to a point which lies 410.0 feet north and 325.0 feet west of the southeast corner of Section 36; thence westerly along a line which is parallel to the south line of said Section 36 a distance of 800.0 feet; thence northerly along a line which is parallel to the east line of said Section 36 to the centerline of 58th Street; thence northwesterly along the centerline of 58th Street to the intersection with the southerly prolongation of the east line of Lot 1, Jandl Addition; thence northerly along said southerly prolongation and the east line of Lots 1, 2 and 3, Jandl Addition to the northeast corner of said Lot 3; thence westerly along the north line of said Lot 3 and the westerly prolongation of said north line to a point which lies 220.0 feet west of the north-south centerline of the said Section 36; thence northerly along a line which is parallel to the north-south centerline of said section to a point which lies 200.0 feet south of the centerline of 56th Street; thence westerly along a line which is parallel to the centerline of 56th Street a distance of 10.0 feet; thence northerly along a line which is parallel to the north-south centerline of said section to the intersection with the centerline of 56th Street; thence easterly along said centerline to the intersection with the north-south centerline of said section; thence northerly along said north-south centerline to the intersection with a line which lies 185.0 feet south of and parallel to the east-west centerline of the said Section 36; thence easterly along said parallel line a distance of 310.0 feet; thence northerly along a line which is parallel to the north-south centerline of said section to the centerline of 55th Street: thence easterly along the said 55th to the point of beginning.

Section 5. That Section No. 1 of Ordinance No. 23134 passed September 19, 1958, establishing Sewer District No. 719, in Sewer Division No. 11, is hereby repealed.

The Sewer Districts herein proposed and this ordinance are recommended for approval and passage this ________ day of __________, 1999.
