ORDINANCE NO. 080507

Authorizing the Director of the City Development to enter into a Termination of Cooperative Agreement for Public Improvement for Signalization at 135th Street and Inverness/Washington Avenue and authorizing the City Clerk to record this ordinance and attached documents.

WHEREAS, on June 23, 2005, City Council passed Committee Substitute for Ordinance No. 050713, which authorized the City to enter into a Cooperative Agreement for Public Improvement for Signalization with the developer of the plat of State Line Station Unit 2 for construction of traffic signals at the intersection of 135th Street and Inverness/Washington Avenue; and

WHEREAS, on October 5, 2005, City and Developer entered into the Cooperative Agreement pursuant to Committee Substitute for Ordinance No. 050713; and

WHEREAS, City issued Permit No. SEC7 70089511 for construction of the traffic signals and has accepted the construction which fulfills the developers obligation set out under the Cooperative Agreement; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of City Development is hereby authorized to enter into a Termination of Cooperative Agreement for Public Improvement for Signalization.

Section 2. That the City Clerk is hereby directed to record copies of this ordinance, together with the Termination of Cooperative Agreement, in the Office of the Recorder of Deeds of Jackson County, Missouri.
