ORDINANCE NO. 960476

Approving the first amendment to the development plan submitted by the L.M. Redevelopment Corporation and authorizing the Director of Finance to enter into a first amendment to contract.

WHEREAS, the Hotel Redevelopment Corporation, an urban redevelopment corporation of Missouri, organized under and pursuant to the Urban Redevelopment Corporations Act of 1945, as amended, did on May 1, 1992, file with the City Clerk an application for approval of a development plan which was approved by the City Council by Ordinance No. 921336, as amended, passed December 10, 1992; and

WHEREAS, the Hotel Redevelopment Corporation assigned its interest in the development plan to the L.M. Redevelopment Corporation on September 28, 1995; and

WHEREAS, the L.M. Redevelopment Corporation did on February 2, 1992, file with the City Clerk an application for a first amendment to the development plan; and

WHEREAS, legal notice for a public hearing on the proposed first amendment to the development plan was published on March 4, 1996; and

WHEREAS, pursuant to said legal notice, a public hearing was held by the City Plan Commission on March 19, 1996; and

WHEREAS, the City Plan Commission has made an independent study and investigation of the proposed first amendment to the development plan and did recommend approval of the proposed first amendment to the development plan and said City Plan Commission has filed with the City Clerk a report recommending approval of same, said report being attached hereto as Exhibit "A"; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the application of the L.M. Redevelopment Corporation for approval of a first amendment to the development plan, including all exhibits incorporated herein and filed with the City Clerk, and is approved as the first amendment to the development plan as originally approved by Ordinance No. 921336, as amended, passed December 10, 1992. A copy of said application and exhibits are on file in the office of the City Clerk under Document No. 960476, which is attached hereto and incorporated herein by reference.

Section 2. That the Council finds and declares that good cause has been shown for the approval of said first amendment to the development plan of L.M. Redevelopment Corporation and that the findings and declarations made by the Council in Section 2 of Ordinance No. 921336, as amended, with respect to the development plan of Hotel Redevelopment Corporation, have not been affected by the amendments thereto and equally apply to said development plan.

Section 3. That the Council hereby finds and determines that the public convenience and necessity will be served by the amended development plan.

Section 4. That the Director of Finance be, and she is hereby, authorized and directed on behalf of the City to enter into a first amendment to contract with L.M. Redevelopment Corporation, a copy of which is attached hereto as Exhibit "B", and which is incorporated herein by reference.
