ORDINANCE NO. 070162

Authorizing the Director of City Development to execute an Amendment to a Deferral Agreement and authorizing the City Clerk to file this ordinance and attached agreement.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. On April 5, 2006, an agreement was made by and between the City of Kansas City, Missouri(City) and 2120 Wyandotte Investors, LLC, a Missouri limited liability company ( Developer).

Section 2. Ordinance No. 060264, passed on March 23, 2006, authorized the director to enter into a secured deferral agreement for public sidewalk improvements.

Section 3. City and the Developer desire to amend the secured deferral agreement for Public Sidewalk improvements.

Section 4. That the Director of City Development is hereby authorized to execute an amendment to the Deferral Agreement for Pubic Improvements, to be in a form substantially as that attached hereto as Exhibit A and incorporated herein by reference.

Section 5. That the City Clerk is hereby directed to file copies of this ordinance, together with the amendment to the Deferral Agreement for Public Improvements in the Office of the Recorder of Deeds of Jackson County, Missouri together with all other relevant documents.
