RESOLUTION NO. 140720

 

Approving and adopting the Title VI program policy of the Federal Transit Administration (FTA).

 

WHEREAS, the City of Kansas City, Missouri is an eligible recipient of federal financial assistance; and

 

WHEREAS, the City of Kansas City, Missouri is required to adhere to the Title VI regulation (49 CFR Part 21) and to integrate activities considerations expressed in the U.S. Department of Transportation’s policy guidance concerning recipient’s responsibility to limited English proficient persons (70 FR 74087, December 14, 2005); and

 

WHEREAS, the City is fully committed to ensure that no person is excluded from participation in, or denied the benefits of its services on the basis of race, color or national origin as protected by Title VI of the Civil Rights Act of 1964, as amended; and

 

WHEREAS, the Title VI program must be submitted every three years; and

 

WHEREAS, the Title VI program must be approved by an eligible recipient’s governing body; and

 

WHEREAS, the Title VI program must contain the following eight elements:

 

·         Notice of rights under Title VI

·         How to file a complaint, copy of complaint form

·         List of Title VI investigations, complaints or lawsuits

·         Public Participation plan

·         Limited English Proficient (LEP) plan

·         Racial breakdown of non-elected advisory councils

·         Narrative describing sub-recipient monitoring

·         Governing body resolution or minutes demonstrating approval of the program;

 

NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Council hereby adopts the Title VI program policy (Policy No. ________) attached hereto as Exhibit A, and that said policy shall take effect immediately.

 

Section 2. That the City Manager, or his designee, is hereby authorized to develop, implement, monitor and execute all required documents necessary to comply with Title VI program requirements of 49 CFR part 26 and Circular 4702.1B.

 

Section 3. That the City Clerk shall attest and certify to the passage and adoption of this resolution and it shall become effective immediately upon its approval.
