Rezoning a 21 acre tract of land
generally located on the north side of N.W. Barry Road and on both sides of N.
Granby Avenue from District R-2.5 to District R-1.5 subject to conditions.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning and Development Code, is hereby amended by enacting a new
section to be known as Section 88-20A1058, rezoning an area of approximately 21
acres generally located on the north side of N.W. Barry Road and on both sides
of N. Granby Avenue from District R-2.5 (Residential dash 2.5) to District
R-1.5 (Residential dash 1.5), said section to read as follows:
Section 88-20A1058. That an area
legally described as:
All of Lots 1 and 2
and Tracts A, B and C, Cosada Villa, a subdivision of land in the City of
Kansas City, Platte County, Missouri described as follows: Commencing at the
Northeast corner of the West Half of the Northeast Quarter of said Section 8,
Township 51, Range 33 in Kansas City, Platte County, Missouri, also being the
Northeast corner of Lot 5 of said Cosada Villa; thence South 00 degrees 28
minutes 47 seconds West, along the East line of said Lot 5 and the East line of
the West Half of the Northeast Quarter of said Section 8, a distance of 600.00
feet to the Point of Beginning of the tract of land herein to be described;
thence continuing South 00 degrees 28 minutes 47 seconds West, along the East
line of the West Half of the Northeast Quarter of said Section 8, along being
the East line of said Lot 1 and its Northerly prolongation thereof, a distance
of 1804.90 feet; thence South 88 degrees 41 minutes 46 seconds east, a distance
of 108.00 feet; thence South 00 degrees 28 minutes 47 seconds West, along the
East line of said Lot 1, a distance of 140.00 feet to the Southeast corner of
said Lot 1, said point also being on the North right of way line of NW. Barry
Road; thence North 88 degrees 41 minutes 46 seconds West, along the South line
of said Lots 1 and 2, also being the North line of said N.W. Barry Road, a
distance of 631.56; thence North 00 degrees 25 minutes 48 seconds East, along
the West line of said Lot 2, a distance of 120.00 feet; thence North 88 degrees
41 minutes 46 seconds West, a distance of 140.00 feet to the Southwest corner
of said Lot 2, said point also being on the East line of Lot 3, Barry Near
Green Hills, a subdivision of land in the City of Kansas City, Platte County,
Missouri; thence North 00 degrees 25 minutes 48 seconds East, along the West
line of said Lot 2 and Tract A of said Cosada Villa and the East line of said
Lot 3, Barry Near Green Hills, and its Northerly prolongation thereof, a
distance of 693.30 feet to the Northwest corner of said Tract A; thence North
50 degrees 18 minutes 12 seconds East, along the Northerly line of said Tract A
to a point of the West line of said Tract B; thence North 05 degrees 55 minutes
59 seconds West, along the Westerly line of said Tract B, a distance of 63.55
feet; thence North 67 degrees 47 minutes 20 seconds East, along the Northerly
line of said Tract B, a distance of 237.64 feet; thence North 32 degrees 47
minutes 01 seconds East, along the Westerly line of said Tract B, a distance of
213.56 feet; thence North 07 degrees 10 minutes 25 seconds West, along the
Westerly line of said Tract B, a distance of 605.76 feet to a point of the
Southerly right of way line of NW. 85th Terrace; thence North 88
degrees 55 minutes 49 seconds West, along said right of way line, a distance of
25.57 feet; thence Northerly along a curve to the left having an initial
tangent bearing of North 03 degrees 45 minutes 01 seconds East and a radius of
425.00 feet, an arc distance of 60.07 feet to a point on the Northerly right of
way line of said N.W. 85th Terrace, said point also being on the South line of
said Lot 5; thence South 88 degrees 55 minutes 49 seconds East, along said
line, a distance of 292.16 feet to the Point of Beginning. Said tract of land
contains 20.28 acres, more or less.
is hereby rezoned from District
R-2.5 (Residential dash 2.5) to District R-1.5 (Residential dash 1.5), all as
shown outlined on a map marked Section 88-20A1058, which is attached hereto and
made a part hereof, and which is hereby adopted as a part of an amendment to
the zoning maps constituting a part of said chapter and in accordance with
Section 88-20 thereof. This rezoning is subject to the following conditions:
1.
The City Council shall approve a development plan for this site prior to
issuance of a building permit or any development occurring on this site (with
the intention of providing connections to properties to the east via N.W. 85th
Terrace).
2.
The developer shall improve N. Granby Avenue to a two-lane road with a
median to the limit of the development at such time that the parcel is
developed.
Section B. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
