COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 130385

 

Declaring certain real property in the Beacon Hill Redevelopment Area to be surplus to needs of City; authorizing the Director of the General Services Department to convey these surplus parcels to the Land Clearance for Redevelopment Authority; and further authorizing the execution of related documents.

WHEREAS, the Council approved a Chapter 353 development plan for the Beacon Hill Redevelopment Project Area and authorized a contract between the City and Beacon Hill Redevelopment Corporation governing the implementation of the development plan by its passage of Committee Substitute for Ordinance No. 020442 on May 23, 2002, both of which have been amended on several occasions by the Council; and

WHEREAS, the City of Kansas City, Missouri and the Beacon Hill Redevelopment Corporation entered into the Redevelopment Contract dated July 23, 2002, and recorded in the office of the Recorder of Deeds for Jackson County, Missouri at Kansas City, on August 17, 2004, as Document No. 2004K0055517; and

WHEREAS, Beacon Hill Developers, L.C., a Missouri limited liability company, is now the successor to Beacon Hill Redevelopment Corporation; and

WHEREAS, the City Manager has determined on behalf of all City departments that most parcels of real property owned by, or to be acquired in the future by, the City within the boundaries of the Beacon Hill project area are considered in excess of the needs of the City and no interest has been expressed by any City Department in retaining the parcels described below for public use; and

 

WHEREAS, except for dedicated easements and public right-of-way, if any, the tracts designated below, all of which lie within the Beacon Hill Redevelopment Project Area, have been identified for redevelopment by the City Council and the City Manager and thus are surplus to the City’s needs; and

WHEREAS, on April 28, 2011, the City Council passed Second Committee Substitute for Ordinance No. 110300, authorizing the City Manager to enter into a contract with the Economic Development Corporation of Kansas City, the Land Clearance for Redevelopment Authority of Kansas City (“LCRA”), the Economic Development Corporation Charitable Fund (“EDCCF”) and the EDC Loan Corporation for the management of assets to be transferred from the Housing and Economic Development Financial Corporation (“HEDFC”) and the City, in part, for the continued development of the Beacon Hill Redevelopment Project; and

WHEREAS, the tracts designated below are needed for the continued redevelopment of the Beacon Hill Redevelopment Project Area by the Beacon Hill Developers, L.C. for the future construction of townhomes; and

WHEREAS, the Beacon Hill Developers, L.C., has previously transferred a parcel of land it purchased from the Housing and Economic Development Financial Corporation in Tract J of the Final Plat of Beacon Hill Northwest Quadrant to LCRA for the purpose of assembling the land needed for the Beacon Hill Student Housing Project at the request of the City with the understanding that the two parcels identified below would be later transferred by the City to LCRA, so that LCRA could then transfer them to it for the purpose of further redevelopment within Beacon Hill; and

WHEREAS, the Beacon Hill Developers, L.C. has also agreed to transfer its title interests in what are now Lot 10 and Tract B of the Final Plat of Beacon Hill Northwest Quadrant and for which the legal description was formerly Tract B, Block 2, Beacon Hill Townhomes in additional exchange for the two parcels identified below; and

WHEREAS, the LCRA is a public body corporate and politic duly organized and existing pursuant to Section 99.330, RSMo, having among its powers the redevelopment of blighted areas and the power of eminent domain; and 

WHEREAS, the parcels of real property set out below are situated within the Hospital Hill II Urban Renewal Area within which the LCRA has the power of eminent domain; and 

 

WHEREAS; Section 99.580, RSMo (Supp. 2011), of the Land Clearance for Redevelopment Authority Law provides, in pertinent part, that: For the purpose of aiding and cooperating in the planning, undertaking or carrying out of a land clearance project located within the area in which it is authorized to act, any public body may, upon such terms, with reasonable consideration, as it may determine to dedicate, sell, convey or lease any of its interest in any property, or grant easements, licenses or any other rights or privileges therein to an authority and the City is such a public body; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds and determines that the City’s current interests in the following parcels of real property owned by the City of Kansas City are no longer needed for public use and are surplus to the needs of the City:

Section 2. That the Director of the General Services Department is hereby authorized to transfer each of the properties listed above to the Land Clearance for Redevelopment Authority for the above-described purpose and said Director is further authorized to execute any real estate or other documents needed to effectuate the transactions noted herein.
