ORDINANCE NO. 140448

 

Enacting a new Section 2-72, Code of Ordinances, entitled “Filing for office” to establish the opening of filing to run for mayor or member of the city council as seventeen weeks prior to the primary election.

 

WHEREAS, the City Charter was amended on April 8, 2014, to establish new election days for Mayor and City Council elections to the first Tuesday after the first Monday in April as the primary election, and the general election 11 weeks thereafter; and

 

WHEREAS, by the City Charter, filing for office closes 12 weeks prior to the primary election; and

 

WHEREAS, unless changed by law or charter §115.127.5 the Revised Statutes of Missouri require filing for office to open 15 weeks before the primary election; and

 

WHEREAS, application of the City Charter and Revised Statutes of Missouri sets filing for the April 7, 2015, primary election to open on December 23, 2014 and close on January 13, 2015; and

 

WHEREAS, by changing the opening of filing the following benefits can be realized:

 

·         The period will begin after the November general election and the work required by the election authorities for that general election;

·         The period allows candidates to use the general election as a way to obtain signatures of registered voters at the November general election;

·         The election authorities are not forced into a short period during holidays in which to process nominating petitions;

·         The election authorities will be given an additional week to process Kansas City candidates before all other municipal or school board candidates will begin filing for office; and

·         The period would avoid potential inconvenience to candidates by opening filing two days before the Christmas holiday;

 

and

 

WHEREAS, by amending the day on which filing for office may begin the filing period for the 2015 City Council election will be December 9, 2014, not December 23, 2014; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That a new Section 2-72, Code of Ordinances, entitled “Filing for office” is enacted to read as follows:

 

Sec. 2-72. Filing for office.

 

A person seeking office as Mayor or a member of the City Council may file with the City Clerk or an election authority of the City, a nomination petition as required by City Charter section 602, on or after the seventeenth Tuesday before the primary election. Consistent with City Charter section 602 filing will end on the twelfth Tuesday before the primary election.
