ORDINANCE NO. 160320

 

Approving the First Amended and Restated General Development Plan for the Union Hill PIEA Planning Area, renamed therein as the 27th & McGee PIEA Planning Area, on about 18.4 acres generally bounded by 27th Street on the north, Gillham Road on the east, McGee Trafficway and 29th Street on the south, and Union Cemetery and Grand Boulevard on the west; and declaring that area a blighted area in need of redevelopment and rehabilitation pursuant to the Planned Industrial Expansion Law. (596-S-1)

 

WHEREAS, the City Council, by Ordinance No. 030846 passed on August 28, 2003, approved the General Development Plan for the Union Hill Planning Area and determined the area to be a blighted, insanitary or undeveloped industrial area in need of industrial development; and

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri (“PIEA”) did prepare or cause to be prepared the First Amended and Restated General Development Plan for the Union Hill PIEA Planning Area (the “General Development Plan”) and recommended that the Council approve the finding of blight and approve the General Development Plan, as renamed therein, for the area and expanded area; and

 

WHEREAS, the PIEA’s Board of Commissioners approved the same via Resolution No. 1776, adopted December 17, 2015; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published as required by law; and

 

WHEREAS, the City Plan Commission has reviewed and recommended approval as evidenced by its disposition of the case and its written recommendations submitted to the applicant on April 7, 2016; and

 

WHEREAS, Section 100.400, RSMo, authorizes the Council to make a finding that an area is a blighted area and approve a general development plan for such area if the Council finds that the plan is feasible and in conformity with the general plan for the development of the community as a whole; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds the First Amended and Restated Union Hill PIEA Planning Area, to be known henceforth as the 27th and McGee PIEA Planning Area, and which area contains approximately 18.4 acres generally bounded by 27th Street on the north, Gillham Road on the east, McGee Trafficway and 29th Street on the south, and Union Cemetery and Grand Boulevard on the west, and more specifically described as follows:

Beginning at the intersection of the South right-of-way line of East 27th Street, as now established, and the East right-of-way line of Grand Boulevard, as now established; thence East along said South right-of-way line of E. 27th Street, as now established, to its intersection with the West right-of-way line of Gillham Road, as now established; thence South along said West right-of-way line of Gillham Road, as now established, to its intersection with the Northeast right-of-way line of McGee Trafficway, as now established; thence Northwesterly and Northerly along said right-of-way line of McGee Trafficway, as now established, to its intersection with the North right-of-way line of E. 29th Street, as now established; thence West along said right-of-way line of E. 29th Street, as now established, to its intersection with the Easterly boundary of Union Cemetery, said point also being on the West boundary of Continuation of Hoelzel’s Addition, a subdivision in Kansas City, Jackson County, Missouri; thence Northerly along said Westerly line of said Continuation of Hoelzel’s Addition, a subdivision in Kansas City, Jackson County, Missouri, to a point 8 feet due west of the southwest corner of Lot 2, Block 11, Continuation of Hoelzel’s Addition, a subdivision in Kansas City, Jackson County, Missouri; thence Northwesterly to a point 42.5 feet Southwesterly of the Westerly line of McGee Trafficway, as now established; thence Southwesterly at a right angle to the Westerly line of McGee Trafficway, as now established, a distance of 41.5 feet; thence Northwesterly to the right 107 degrees 55 minutes 43.26 feet; thence Northeasterly at a right angle to the Westerly line of McGee Trafficway, as now established, a distance of 27.72 feet to a point 2.37 feet Northerly of the Southwest corner of Lot 2, Union Terminal Addition, a subdivision in Kansas City, Jackson County, Missouri, said point also being on the Northerly boundary of Union Cemetery; thence the following ten courses along said Northerly boundary of Union Cemetery, said boundary also being the Southerly boundary of said Union Terminal Addition: North 33 degrees 59 minutes 0” seconds West, a distance of 156.04 feet; thence Northwesterly and Westerly along a curve to the left, tangent to the last described course, having a radius of 120.00 feet and a central angle of 92 degrees 30 minutes 00 seconds, an arc distance of 193.73 feet; thence South 53 degrees 31 minutes 00 seconds West, a distance of 107.23 feet; thence Southerly along a curve to the left, tangent to the last described course, having a radius of 100.00 feet and a central angle of 46 degrees 02 minutes 30 seconds, and arc distance of 80.36 feet; thence South 7 degrees 28 minutes 30 seconds West, a distance of 99.00 feet; thence South 33 degrees 51 minutes 45 seconds West, a distance of 78.50 feet; thence South 89 degrees 46 minutes 15 seconds West, a distance of 82.00 feet; thence Westerly and Northwesterly along a curve to the right, tangent to the last described course, having a radius of 100.00 feet and a central angle of 62 degrees 11 minutes 00 seconds, an arc distance of 108.53 feet; thence Northwesterly and Westerly along a curve to the left, having a common tangent with the last described curve, a radius of 200.00 feet and a central angle of 62 degrees 11 minutes 00 seconds, an arc distance of 217.06 feet; thence South 89 degrees 46 minutes 15 seconds West, a distance of 0.84 feet to the Northwest corner of said Union Cemetery, said point also being on the Northerly prolongation of the East line of Lot 60, said Union Terminal Addition; thence South along said East line of Lot 60 a distance of 207.35 feet to the Northeast corner of Jackson County Parcel No. 29-820-01-07-00-0-00-000; thence West along the North line of Jackson County Parcel No. 29-820-01-07-00-0-00-000 to its intersection with the East right-of-way line of Grand Boulevard, as now established; thence Northeasterly and Northerly along said East right-of-way line of Grand Boulevard, as now established, to the Point of Beginning

 

to be a blighted area as defined in Section 100.310, RSMo, and more specifically finds that there is a predominance of insanitary and unsafe conditions and a deterioration of site improvements, and as a result of the predominance of those conditions the planning area in its present condition and use constitutes an economic liability.

 

Section 2. That the General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.

 

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo.

 

Section 4. That a copy of the General Development Plan is attached to this ordinance and is made a part hereof and is hereby approved.

 

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, may be extended to the plan area to the extent and in the manner as provided for in the General Development Plan, subject to the execution of a development agreement between the PIEA and a developer.
