Approving the preliminary plat of
Bank of America Processing Facility on a 26.8 acre tract of land generally
located at the southeast corner of N.E. L.P. Cookingham Drive (Highway 291) and
N. Woodland Avenue. (SD-1401)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Bank of America Processing Facility on a 26.8 acre
tract of land generally located at the southeast corner of N.E. L.P. Cookingham Drive (Highway 291) and N. Woodland Avenue, and more specifically described
as follows:
A
tract of land in the Southeast Quarter of Section 24, Township 52, Range 33,
Kansas City, Clay County, Missouri, more particularly described as follows: Commencing
at the Center Quarter (C) Corner of said Section 24 as shown on Missouri
Corner Document #600-28314 dated April 1981, W.M. Spann Jr., LS#19 (Found
5/8" Iron Bar, August 2008), said point bears North 8911'55" West, a
distance of 2618.20 feet from the East Quarter Corner of said Section 24 as
shown on Missouri Corner Document #600-54101 dated November 1994, W.M. Spann
Jr., LS#19 (Found 2" Cap, Clay County Section Corner, August 2008);
thence South 2009'55" East, a distance of 85.67 feet to the point of
beginning at the intersection of the East right-of-way line of N. Woodland
Avenue as established by Deed Bk. 503, Page 86 (30' East of centerline) with
the South right-of-way line of MO Route 291 (40' South of centerline); thence
South 8911'55" East, along said South right-of-way line, a distance of
1279.13 feet to the East line of the West Half of said Southeast Quarter of
Section 24 (Found 1/2" Iron Bar, 0.12'E); thence South 0018'45"
West, along said East line, a distance of 906.77 feet (Found 1/2" Iron Bar
w/Cap, LS#1989, 0.6'E); thence North 8936'27" West, a distance of 1279.40
feet to said East right-of-way line of N. Woodland Avenue (Found 1/2" Iron
Bar w/Cap, LS#1989, 1.5'E); thence North 0019'57" East, along said East
right-of-way line, a distance of 915.90 feet to the point of beginning. Containing
1,165,824 Sq.Ft. (26.76 Ac.) more or less.
is hereby approved, subject to
the following conditions:
1.
That the developer receive approval from the Board of Zoning Adjustment
for any necessary variances prior to approval of a final plan.
2.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
3.
That the developer submit a micro storm drainage study to Development
Services for review and acceptance for this phase when the final plat is
submitted, and that the developer secure permits to construct any improvements
as required by Development Services prior to recording the final plat.
4.
That the developer submit plans for grading and siltation and erosion
control to Development Services for approval prior to the commencement of any
construction activities.
5.
That the developer dedicate additional right of way for a primary
arterial with a bike lane as required by Development Services so as to provide
a minimum of 56 feet of right of way as measured from the centerline of N.E. Cookingham Drive.
6.
That the developer dedicate the permanent grading easements necessary
for the construction of N. Woodland Avenue, on the final plat, as required by
Development Services.
7.
That the developer dedicate additional right of way for a primary
arterial with a bike lane as required by Development Services so as to provide
a minimum of 96 feet of right of way as measured from the section line of N. Woodland Avenue.
8.
That the developer extend sanitary sewers as required by Development
Services.
9.
That the developer comply with the height restrictions of the KCI Airport height zoning map.
10.
That the developer subordinate to the City all private interest in the
area of any right-of-way dedication as required by Development Services, and
that the developer be responsible for all costs associated with subordination
activities now and in the future.
11.
That the developer secure a site disturbance permit from Development
Services prior to beginning any construction, grading, clearing, or grubbing
activities, if the disturbed area equals one acre or more, prior to recording
the plat.
12.
That the developer grant a BMP Easement to the City as required by
Development Services, prior to recording the plat.
13.
That the developer submit a final plan to the City Plan Commission for
approval that includes, plans for grading, building/substation elevations,
landscaping, screening (including wall), signage, lighting and photometric
study showing zero footcandles at the lot lines. An extensive landscaping plan
that addresses the view along N. Woodland Avenue and complements the proposed
fence and detention pond in front of the building will be required during final
plan review.
14.
That the developer will construct the 10 foot wide shared use trail
shown on the preliminary plat, in accordance with the Trails KC Plan, prior to
the issuance of a certificate of occupancy.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
