ORDINANCE NO. 010185
Approving
a development plan in District GPA (Agricultural Uses) on approximately a 33.7 acre
tract of land generally located on the west side of South Raytown Road,
approximately one-half mile north of Highgrove Road/Scherer Road. (10311-GP-1)
BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That a development plan in District GPA (Agricultural Uses) on
approximately a 33.7 acre tract of land generally located on the west side of
South Raytown Road, approximately one-half mile north of Highgrove Road/Scherer
Road, and more specifically described as follows:
All that part of the East 1/2 of 17, Township 47
North, Range 32 West, in Kansas City, Jackson County, Missouri, including
Longview Memorial Gardens, a plat for cemetery purposes, described as follows:
Beginning at the southwest corner of the Northeast 1/4 of said Section 17;
thence North 2E28'06" East along
the west line of said 1/4 Section, a distance of 827.15 feet to the southwest
corner of the North 1/2 of the South 1/2 of the Northwest 1/4 of the Southwest
1/4 of the Northeast 1/4 of said Section 17, also being the southwest corner of
a tract of land conveyed to the United States of America by Warranty Deed
recorded as Document No. I-324455; thence South 87E20'57" East along the south line of
said tract of land, a distance of 659.26 feet to the northwest corner of Lot 2,
Goetz Addition, a subdivision of land; thence South 2E23'15" West along the west line of
said Lot 2, a distance of 165.41 feet to the southwest corner thereof; thence
South 87E22'25" East along
the south line of said Lot 2 and the easterly prolongation thereof, a distance
of 665.00 feet to a point on the east line of the Southwest 1/4 of the
Northeast 1/4 of said Section 17; thence South 2E30'28" West along the east line of said 1/4
1/4 Section, a distance of 680.64 feet to the southeast corner thereof; thence
South 2E29'42" West along
the east line of the North 1/2 of the Northwest 1/4 of the Southeast 1/4 of
said Section 17, a distance of 665.05 feet to the southeast corner thereof;
thence North 87E26'12" West along
the south line of said 1/2 1/4 1/4 Section, a distance of 41.80 feet to a point
on the west right of way line of Raytown South Road, as now established, by
conveyance recorded in Book 572, page 215, as Document No. 303795; thence South
2E40'43" West along
said right of way line, a distance of 20.64 feet to a point on the easterly
prolongation of a fence line; thence North 88E21'26" West along said prolongation and
said fence, being the south line of the tract of land described in the Quit
Claim Deed recorded in Book 1679, page 612, as Document No. 831781, a distance
of 458.24 feet; thence North 86E32'20"
West along said fence, a distance of 300.04 feet; thence North 85E35'47" West along said fence, a
distance of 505.67 feet to the northwest corner of said fence; thence North 2E35'44" East, a distance of 10.00
feet to a point on the south line of the North 1/2 of the Northwest 1/4 of the
Southeast 1/4 of said Section 17; thence North 87E26'12" West along said south line, a
distance of 19.70 feet to the southwest corner thereof; thence North 2E35'44" East along the west line of
the last said 1/2 1/4 1/4 Section, a distance of 665.69 feet to the point of
beginning. Except that part in Raytown South Road as established by
conveyances
recorded
in Book 572, page 215, as Document No. 303795, and in Book 572, page 218 as
Document No. 303798.
is
hereby approved, subject to the following conditions:
1. That the developer submit plans
for grading and siltation and erosion control to the City Engineers Office for
approval prior to beginning any construction activities.
2. That the developer secure a
land disturbance permit from the Department of Public Works prior to beginning
any construction, grading, clearing or grubbing activities, if the disturbed
area exceeds one acre.
3. That the developer submit a
final plan to the City Plan Commission for approval, including plans for
landscaping, screening, grading and building elevations.
A copy of said development
plan is on file in the office of the City Clerk under Document No. 010185,
which is attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices have been given and hearings have
been held as required by the Zoning Ordinance.
