ORDINANCE NO. 090946

 

Approving the development plan submitted by the RW Redevelopment Corporation for the redevelopment of the two story historic OH Dean building located at the northeast corner of 37th Street and Main Street (3635 Main and parking lot); declaring the area included in such plan to be a blighted area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare; authorizing the Director of Finance to enter into a contract with the RW Redevelopment Corporation; and authorizing certain tax abatement for the area included in such plan. WHEREAS, on August 21, 2008, the RW Redevelopment Corporation, an urban redevelopment corporation organized under and pursuant to the Urban Redevelopment Corporations Law and amendments thereto, filed with the City Clerk of Kansas City an application for approval of a development plan (Development Plan) which contemplates the redevelopment the two story historic OH Dean building located at the northeast corner of 37th Street and Main Street (3635 Main and parking lot), Kansas City, Missouri (the Redevelopment Project); and

 

WHEREAS, the City Clerk referred the Development Plan to the City Plan Commission of Kansas City (City Plan Commission); and

 

WHEREAS, the City Plan Commission published a notice for the public hearing on the Development Plan in The Daily Record, a local news publication, on September 21, 2009, such date being not less than ten (10) days prior to the date set for the public hearing; and

 

WHEREAS, on October 6, 2009, the City Plan Commission conducted a public hearing on the Development Plan; and

 

WHEREAS, all interested parties were given an opportunity to be heard at the public hearing; and

 

WHEREAS, the City Plan Commission has studied and investigated the Development Plan and on October 6, 2009, the City Plan Commission recommended the approval thereof and of the finding of blight, and submitted a report of the same, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Development Plan submitted by the RW Redevelopment Corporation for the construction of the Redevelopment Project, a copy of which is on file in the office of the City Clerk with this ordinance, is hereby approved.

 

Section 2. That the City Council finds and declares that: (i) the area described in the Development Plan is a blighted area as defined by Section 353.020(2) of the Revised Statutes of Missouri, and Section 74-4 of the Code of Ordinances of the City; and (ii) approval of the Development Plan and construction of the Redevelopment Project are necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare.

 

Section 3. That the Director of Finance be, and he is hereby, authorized and directed on behalf of the City to enter into a contract with the RW Redevelopment Corporation for the construction of the Redevelopment Project.

 

Section 4. That the RW Redevelopment Corporation is hereby granted twenty years of tax abatement with PILOTS as specified in the contract for the Redevelopment Project on the land and improvements located therein, subject to the terms of the contract.
