Rezoning an area of approximately 13.6 acres generally located approximately 1,100 feet north of Tiffany Springs Road, between N. Congress Avenue and Interstate 29 from Districts GP-1 and GP-7 to District GP-3, and approving a development plan for the same. (10251-GP-17)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0616, rezoning an area of approximately 13.6 acres generally located approximately 1,100 feet north of Tiffany Springs Road, between N. Congress Avenue and Interstate 29 from Districts GP-1 (General Industry) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-3 (Regional Business), said section to read as follows:

 

Section 80-11A0616. That an area legally described as:

 

All that part of Lots 2, 3, 4 and 5, Sarah Glass Place, a subdivision of land in the City of Kansas City, Platte County, Missouri, in the Northeast Quarter of Section 1, Township 51, Range 34, described as follows: Commencing at the Southwest corner of the Northeast Quarter of said Section 1, thence North 00 degrees 26 minutes 15 seconds East, along the West line of said Section 1, a distance of 1005.32 feet; thence South 89 degrees 54 minutes 40 seconds East, a distance of 50.0 feet, to the Easterly Right-of-Way line of North Congress, also being the Point of Beginning of the Tract of land herein to be described; thence North 00 degrees 26 minutes 15 seconds East, along the Easterly Right-of-Way line of said North Congress, a distance of 248.50 feet; thence continuing along the Easterly Right-of-Way line of said North Congress, North 01 degrees 40 minutes 59 seconds West, a distance of 247.54 feet to the South line of Tiffany Springs Auto Plaza, a subdivision of land in the City of Kansas City, Platte County, Missouri; thence North 89 degrees 58 minutes 47 seconds East, along the South line of said Tiffany Springs Auto Plaza, a distance of 399.77 feet; thence continuing along the South line of said Tiffany Springs Auto Plaza, South 00 degrees 26 minutes 15 seconds West, a distance of 79.34 feet; thence continuing along the South line of said Tiffany Springs Auto Plaza, North 89 degrees 58 minutes 47 seconds East, a distance of 196.60 feet; thence continuing along the South line of said Tiffany Springs Auto Plaza, thence North 00 degrees 01 minutes 13 seconds West, a distance of 79.34 feet; thence continuing along the South line of said Tiffany Springs Auto Plaza, North 89 degrees 58 minutes 47 seconds East, a distance of 457.44 feet to the Westerly Right-of-Way line of Interstate 29; thence South 29 degrees 31 minutes 02 seconds East, along the Westerly Right-of-Way line of said Interstate 29, a distance of 105.03 feet; thence continuing along the Westerly Right-of-Way line of said Interstate 29, South 89 degrees 57 minutes 46 seconds East, a distance of 34.03 feet; thence continuing along the Westerly Right-of-Way line of said Interstate 29, South 29 degrees 31 minutes 02 seconds East, a distance of 96.29 feet; thence continuing along the Westerly Right-of-Way line of said Interstate 29, South 60 degrees 28 minutes 58 seconds West, a distance of 5.00 feet; continuing along the Westerly Right-of-Way line of said Interstate 29, South 29 degrees 31 minutes 02 seconds East, a distance of 100.00 feet; thence continuing along the Westerly Right-of-Way line of said Interstate 29, North 60 degrees 28 minutes 58 seconds East, a distance of 5.00 feet; thence continuing along the Westerly Right-of-Way line of said Interstate 29, South 29 degrees 31 minutes 02 seconds East, a distance of 271.42 feet to the Northeast corner of Tiffany Springs Auto Plaza II, a subdivision of land in the City of Kansas City, Platte County, Missouri; thence North 89 degrees 54 minutes 40 seconds West, along the North line of said Tiffany Springs Auto Plaza II, and its Westerly prolongation thereof a distance of 1364.01 feet to the Point of Beginning.

 

is hereby rezoned from Districts GP-1 (General Industry) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-3 (Regional Business), all as shown outlined on a map marked Section 80-11A0616, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a storm drainage study to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3.                  That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4.                  That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing, or grubbing activities if the disturbed area exceeds one acre.

 

5.                  That the developer comply with the Kansas City International Airport Height Zoning restrictions and that such restrictions be included on the final plat as required by the City.

 

6.                  That the developer grant an Aviation Noise Easement (for each phase) to the City and file same with each final plat as required by the Aviation Department.

 

7.                  That the developer receive the approval of the Missouri Department of Transportation prior to working within any State right-of-way.

 

8.                  That the developer receive the approval of the Missouri Department of Transportation for access locations onto N.W. Prairie View Road.

 

9.                  That the developer extend water mains as required by the Water Services Department.

 

10.              That the developer extend sanitary sewers as required by the Department of Public Works.

 

11.              That the developer provide for fire protection as required by the Fire Department.

 

12.              That the developer submit covenants, conditions, and restrictions to the Law Department for approval by the City for maintenance of any detention areas with the final plat.

 

13.              That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming, signage and a lighting plan (provide a photometric study showing zero footcandles at the property line, with the intent that there shall be no direct illumination beyond the property line and the color of light fixtures shall be other than bright yellow).

 

15. That the developer provide a left-hand turn lane on south-bound N. Congress Avenue for traffic turning into the west entrance to the property, which shall include 35.7 feet of stacking.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
