Accepting various easements and deeds in Jackson, Clay and Platte Counties; releasing various easements; and directing the City Clerk to record the acceptance.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 5. That the legal descriptions for such properties listed in Sections 1, 2, 3 and 4 are set forth in Exhibit A, which is attached hereto and incorporated herein by reference.

 

Section 6. That the platted utility 15 foot sanitary sewer easement located through part of Section 35, Township 51, Range 33, lying 7.5 feet on either side of the following described centerline: beginning at a point on the west line of the southeast quarter of the southwest quarter of said Section 35, said point being 883.22 feet north, as measured along said west line, from the southwest corner of the southeast quarter of the southwest quarter of said Section 35; thence north 80 degrees 55 minutes 15 seconds east 209.55 feet to a point that is 916.13 feet north and 217.78 feet east (by coordinate) from the southwest corner of the southeast quarter of the southwest quarter of said Section 35, being also the point of termination all in Kansas City, Clay County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns as further evidence thereof.

 

Section 7. That the platted utility easement located along the southeasterly 10 feet of Lot 104, Trails of North Brook 2nd Plat, except the northerly 10 feet and the southeasterly 10 feet thereof, all in Kansas City, Clay County, Missouri, be and the same is hereby released to its present owners, their heirs and assigns, and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns as further evidence thereof.

 

Section 8. All that part of the east 5 feet of the platted 10 foot utility easement lying along and adjacent to the west property line and being southerly of a line drawn parallel and 10 feet south of the north property line, and all that part of the platted 10 foot utility easement lying along and adjacent to the east property line and being southerly of a line drawn parallel and 10 feet south of the north property line of property described as: all that part of Lot 4, Wexford Place First Plat, a subdivision of land in Kansas City, Platte County, Missouri, described as beginning at the northwest corner of said Lot 4, said point being at the intersection of the south line of N.W. 66th Street Terrace with the west line of the southwest quarter of Section 19, Township 51 N, Range 33 W; thence south 88 degrees 22 minutes 22 seconds east, along the northerly line of said Lot 4, a distance of 46.42 feet to an angle point therein, thence south 1 degree 37 minutes 38 seconds west, continuing along the platted northerly line of said Lot 4 (being the east line of the herein described property), a distance of 126.29 feet, to an angle point therein; thence south 81 degrees 52 minutes 47 seconds west, departing from said platted northerly line, a distance of 43.48 feet to a point on the west line of said Lot 4; thence north 0 degrees 05 minutes 56 seconds east, along said west line, a distance of 133.70 feet to the point of beginning; be and the same are hereby released to its present owners, their heirs and assigns (the intent being to retain a 5 foot utility easement along and adjacent to the west line and a 10 foot utility easement along and adjacent to the north line of said herein described property), and the Director of Public Works, if so requested, is authorized to execute a quit-claim deed to the present owners, their successors or assigns as further evidence thereof.

 

Section 9. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the offices of the Recorder of Deeds for Jackson County, Missouri, at Kansas City and Independence, Clay County, Missouri, at Liberty, and for Platte County, Missouri, at Platte City, respectively.
