ORDINANCE NO. 981414
Approving an amendment to a previously approved
preliminary plan in District CP-2 (Local Planned Business Center) on
approximately a 6.3 acre tract of land generally located on the south side of
N.E. Barry Road, approximately 1,200 feet east of N. Troost Avenue, for the
purpose of deleting an approximately 0.828 acre tract of land from said
preliminary plan. (4460-CP-2)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved preliminary plan in District CP-2 (Local Planned Business
Center) on approximately a 6.3 acre tract of land generally located on the
south side of N.E. Barry Road, approximately 1,200 feet east of N. Troost
Avenue, and more specifically described as follows:
All that part of Section
12, Township 51, Range 33 in Kansas City, Clay County, Missouri, described as
follows: Beginning at point in the east line of the Northwest Quarter of the
Southwest Quarter of said Section 12 which is 175.00 feet North
0006"59" East of the southeast corner of said Quarter-Quarter
Section; thence North 8826'34" West and parallel to the south line of
said Quarter-Quarter Section, a distance of 405.00 feet; thence northerly along
a curve to the right having a radius of 290.81 feet, a distance of 74.44 feet
to the point of tangency of said curve; thence North 1453'26" East along
said tangent, a distance of 260.00 feet to the point of a curve to the left
having a radius of 354.07 feet; thence along said curve, a distance of 127.71
feet to the point of tangency; thence North 0546'34" West along said
tangent, a distance of 10.25 feet; thence North 8413'26" East, a distance
of 196.01 feet; thence North 1313'20" West, a distance of 140.04 feet;
thence northeasterly along a curve to the left having a radius of 50.00 feet
and to which curve the last described line is radial, a distance of 141.61
feet; thence North 0430'00" East on a line which is also radial to said
curve, a distance of 150.00 feet; thence North 3215'00" East, a distance
of 35.00 feet; thence North 5805'00" West, a distance of 112.32 feet;
thence North 0355'05" West, a distance of 175.00 feet to a point in the
south right of way line of Missouri Highway M-152 (Barry Road); thence easterly
along said right of way line which is a curve to the left having a radius of
751.20 feet, a distance of 250.00 feet to a point in the east line of the
Southwest Quarter of the Northwest Quarter of said Section 12; thence South 0002'40"
East along said east line, a distance of 55.20 feet to the southeast corner of
said Quarter-Quarter Section; thence South 0006'59" West along the east
line of the Northwest Quarter of the Southwest Quarter of said Section 12, a
distance of 1143.08 feet to the point of beginning.
for the purpose of deleting therefrom an
approximately 0.828 acre tract of land, more specifically described as follows:

follows: Commencing at the southeast corner of the Northwest Quarter of said
Southwest Quarter; thence North 0023'56" East along the east line of said
Northwest Quarter of the Southwest Quarter, a distance of 175.03 feet to the
point of beginning of the tract of land to be described: Thence North
8833'09" West, a distance of 337.01 feet; thence North 0100'33"
East, a distance of 107.23 feet; thence South 8833'07" East, a distance
335.87 feet to a point on said east line; thence South 0023'56" West, a
distance of 107.24 feet to the point of beginning. Contains 36,074 square feet
or 0.828 acres more or less.
so that the remaining tract
of land of approximately 5.526 acres, more specifically described as follows:

in the West Half of Section 12, Township 51, Range 33, Kansas City, Clay
County, Missouri, being more particularly described as follows: Commencing at
the southeast corner of the Northwest Quarter of the Southwest Quarter of said
Section 12; thence North 0023'56" West along the east line of said
Southwest Quarter, a distance of 282.27 feet to the point of beginning of the
tract of land to be described; thence North 8833'07" West, a distance of
335.87 feet; thence North 0100'33" East, a distance of 204.03 feet;
thence North 1510'23" East, a distance of 18.37 feet; thence on a curve
to the left tangent to the last described course, having a radius of 354.07
feet and an arc distance of 127.71 feet; thence North 8430'23" East, a
distance of 196.01 feet; thence North 1256'23" West, a distance of 140.04
feet; thence on a curve to the left having an initial tangent bearing of North
7703'37" East, a radius of 50.00 feet, and an arc distance of 141.61
feet; thence North 0446'57" East, a distance of 150.00 feet; thence North
3231'57" East, a distance of 35.00 feet; thence North 5748'03"
West, a distance of 112.32 feet; thence North 0338'08" West, a distance
of 72.25 feet; thence North 0041'36" East, a distance of 100.57 feet to a
point on the south right of way line of Barry Road; thence along said south
right of way line, on a curve to the left having an initial tangent bearing of
North 8451'37" East, a radius of 751.20 feet and an arc distance of
244.37 feet to a point of the east line of the West Half of said Section 12;
thence South 0023'56" West along said east line a distance of 1093.47
feet to the point of beginning. Contains 240,745 square feet or 5.526 acres
more or less.
is hereby approved, subject to the following
conditions:
1. That
the developer extend water mains as required by the Water Services Department.
2. That
the developer provide for fire protection as required by the Fire Department.
3. That
the developer dedicate additional right of way for N.E. Barry Road as required
by the Department of Public Works so as to provide a total of 50 feet of right
of way as measured from the centerline of N.E. Barry Road.
4. That
the developer submit a final plan to the City Plan Commission for approval,
including plans for landscaping, grading and signage, prior to the issuance of
a building permit.
A copy of said amendment is on file in the
office of the City Clerk under Document No.981414, which is attached hereto and
made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
