ORDINANCE NO. 100317
Declaring it necessary to change
and reestablish the grades of, and the relocation, opening, establishing and
dedicating of street right of way on N.E. 96th Street (Shoal Creek Parkway),
all in Kansas City, Clay County, Missouri; and directing the City Clerk to
cause a notice to be published as provided for herein.
WHEREAS, the
Council finds that for the public good it is necessary that the grades on N.E.
96th Street which when construction is complete will become Shoal Creek
Parkway; and
WHEREAS, the
Council further finds that for the public good it is necessary to relocate,
open, establish and dedicate street right of way on Shoal Creek Parkway, all in
Kansas City, Clay County, Missouri; and
WHEREAS, the
Council further finds the Director of Public Works, as evidenced by his issuing
a Declaration of Necessity, No. 5489, adopted and entered on March 24, 2010,
has caused the plans and specifications for Project No. 70102358 - Street and
Storm Water Improvements to Shoal Creek Parkway to be prepared; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Council finds and declares it necessary to establish said grades on Shoal
Creek Parkway, currently known as N.E. 96th Street, all in Kansas City, Clay
County, Missouri, with the following described centerline as follows, to wit:
Commencing at the
Northwest corner of the Northwest Quarter of Section 4, Township 51 North,
Range 32 West of the 5th Principal Meridian in the City of Kansas City, Clay
County, Missouri; thence easterly along the North line of the aforementioned
Section 4 along a bearing of North 89 degrees 15 minutes 29 seconds East , a
distance of 519.78 feet to a point; thence Northerly along a bearing of North
00 degrees 44 minutes 31 seconds East, a distance of 92.31 feet to a point on
the eastbound centerline of the proposed Shoal Creek Parkway, said point being a
Point on Tangent and the Point Of Beginning and Station 108+00; thence North 85
degrees 41 minutes 52 seconds East a distance of 437.93 feet to a Point of
Curvature stationed 112+37.93, thence along a curve to the right with a radius
of 1,300 feet a distance of 438.41 feet and which said curve has a Point of
Inflection at station 114+59.23 and a deflection angle of 19 degrees 19 minutes
20 seconds right to a Point on Tangent stationed 116+76.33, thence South 74
degrees 58 minutes 48 seconds East a distance of 135.16 feet to a Point of
Curvature stationed 118+11.49, thence along a curve to the left with a radius
of 2,000 feet a distance of 496.32 feet and which said curve has a Point of
Inflection at station 120+60.93 and a deflection angle of 14 degrees 13 minutes
07 seconds left to a Point on Tangent stationed 123+07.81, thence South 89
degrees 11 minutes 55 seconds East a distance of 2,056.07 feet to a Point of
Curvature stationed 143+63.88, thence along a curve with a radius of 15,013.22
feet a distance of 941.37 feet and which said curve has a Point of Inflection
at station 148+34.71 and a deflection angle of 03 degrees 35 minutes 33 seconds
left to a Point of compound Curvature stationed 153+05.25, thence along a curve
having an Initial Tangent Bearing of North 87 degrees 12 minutes 32 seconds
East with a radius of 160.05 feet a distance of 152.65 feet and which said
curve has a Point of Inflection at station 153+87.93 and a deflection angle of
54 degrees 38 minutes 41 seconds right to a Point of compound Curvature
stationed 154+57.89, thence along a curve having an Initial Tangent Bearing of
South 38 degrees 14 minutes 53 seconds East with a radius of 100.95 feet a
distance of 159.82 feet and which said curve has a Point of Inflection at
station 155+60.10 and a deflection angle of 90 degrees 42 minutes 42 seconds
left to a Point of compound Curvature stationed 156+17.82, thence along a curve
having an Initial Tangent Bearing of North 51 degrees 08 minutes 30 seconds
East with a radius of 212.10 feet a distance of 154.27 feet and which said
curve has a Point of Inflection at station 156+98.54 and a deflection angle of
41 degrees 40 minutes 21 seconds left to a Point of compound Curvature
stationed 157+72.08, thence along a curve having an Initial Tangent Bearing of
North 87 degrees 11 minutes 27 seconds West with a radius of 812.00 feet a
distance of 172.68 feet and which said curve has a Point of Inflection at
station 158+58.75 and a deflection angle of 12 degrees 11 minutes 04 seconds
right to a Point of compound Curvature stationed 159+44.82, thence along a
curve having an Initial Tangent Bearing of South 75 degrees 00 minutes 04
seconds East with a radius of 1,806.93 feet a distance of 284.73 feet and which
said curve has a Point of Inflection at station 160+87.48 and a deflection
angle of 09 degrees 01 minutes 42 seconds right to a Point of compound
Curvature stationed 162+29.55, thence along a curve having an Initial Tangent
Bearing of North 65 degrees 58 minutes 22 seconds West with a radius of
1,368.00 feet a distance of 176.70 feet and which said curve has a Point of
Inflection at station 163+45.74 and a deflection angle of 09 degrees 42 minutes
33 seconds right to a Point of Curvature Stationed 164+06.25 and said Point
being located on the existing eastbound centerline of Shoal Creek Parkway and
said Point being South 75 degrees 51 minutes 59 seconds East and a distance of
826.59 feet from the Northwest Corner of the Northwest Quarter of Section 3,
Township 51 North, Range 32 West.
Section 2. That
the Council hereby directs that the City Clerk cause a notice of said grade
changes to be published in the newspaper doing the city printing, on each day
of issue of said newspaper for a period of ten (10) days, starting on or about the
date following the passage of this ordinance,and providing a period of thirty
(30) days for remonstrance starting the same day as the first day of the
publication.
Section 3. That
said grade changes shall be of the nature described and specified in, and shall
be done in accordance with the plans and specifications prepared under the
supervision of the Director of Parks and Recreation and identified as Project
No. 70102358, Shoal Creek Parkway, the same being on file in the Office of the
Director of Parks and Recreation and being incorporated herein by reference.
Section 4. That
the width of the right of way of Shoal Creek Parkway, as shown on the plans
described in Section 3 of this ordinance, are hereby relocated, opened,
established and dedicated as shown on said plans.
Section 5. That
changing and reestablishing grades on N.E. 96th Street also known as Shoal
Creek Parkway, from a point 306.52 feet east of the centerline of I-435 to a
point 5,912.77 feet east of I-435, said point being near the existing N.E. 96th
Street – Shoal Creek Parkway roundabout, is hereby authorized to commence when
this ordinance becomes effective, and shall be built in accordance with the
plans and specifications as described in Section 3 of this ordinance; locating
and defining the grade points of said streets on the proposed project baseline
stationing as found on said plans, said grade points being connected by
straight grades (tangents) or vertical curves between such grade points, the
elevations of which are herein given below in feet (NAVD88 directrix), along
with other pertinent alignments data, to-wit:
